'a <br />Resolution 2000-47 <br />A' <br />Page 6 <br />37. The developer shall provide the City with 184 feet of total right-of-way for the future <br />upgrade of CSAH 8 (Frenchman Road). The right-of-way shall be dedicated with the <br />final plat for the first phase of the development. <br />38. The developer shall pave Elmcrest Avenue north of CSAH 8 to the northerly property <br />line of the development. The road shall be 30 feet wide and a 9 -ton design. The <br />grades at the intersection of Elmcrest Avenue and Co. Rd. 8 shall be adjusted to <br />insure proper sight distances. <br />39. The developer shall be responsible for the upgrade and paving of Elmcrest (140x' <br />Street) along the southern end of the property. Because the road is currently gravel <br />east and west of the development site, the applicant shall not pave the street at this <br />time; but rather, put money in escrow for the future upgrade. <br />40. The street plan proposed by the developer includes vacating a portion of Elmcrest <br />Avenue. Elmcrest Avenue is a shared roadway between the Cities of Lino Lakes and <br />Hugo. The Cities of Hugo and Lino Lakes have formally vacated the road pending <br />approval of a preliminary and final plat. <br />41. This development is dependent upon a joint powers agreement between the City of <br />Hugo and the City of Lino Lakes for the provision of municipal water service to the <br />development. The joint powers agreement must be signed prior to recording the final <br />plat. <br />42. Sidewalks shall be required along both sides of all public streets. <br />43. Cross access and maintenance agreements shall be recorded with the final plat for all <br />shared private driveways or streets. <br />Parks/Open Space <br />44. The amount of land area devoted to park and open space shall be consistent with the <br />concept plan. At the time of preliminary plat application, the applicant shall <br />demonstrate that the park/open space plan includes at least 100 square feet of exterior <br />play or recreation area for each townhome and apartment unit, as required by City <br />ordinance. For the purpose of applying this condition, the residential units north and <br />south of CSAH 8 shall be considered separate developments. <br />45. The City Council, with a recommendation from the Parks Commission, shall <br />determine what parkland will be accepted as City parkland and what parkland will <br />remain private. This determination will be made at the time of preliminary plat <br />review. <br />
