RESOLUTION 1996-22 <br />A RESOLUTION REQUESTING THAT WASHINGTON COUNTY <br />ASSUME RESPONSIBILITY FOR THE CONSTRUCTION AND <br />MAINTENANCE OF A STORMWATER CONTROL OUTLET TO <br />CONTROL THE FLOODING OF THE SCHOOL SECTION/GOGGINS <br />LAKE DRAINAGE BASIN. <br />WHEREAS, since the late 1980's, School Section Lake, Plaisted Lake, and <br />Goggins Lake have experienced increased water elevations; and <br />WHEREAS, in the summer of 1995, the surface water level in the basin exceeded <br />the lakes' ordinary high water level by approximately six feet, inundating over 200 <br />acres of land, one County road, one City street, while affecting numerous homes, <br />and <br />WHEREAS, the flood waters have not substantially receded since 1995, causing <br />concern that future spring stormwater runoff will compound already high water <br />levels; and <br />WHEREAS, the Town of May and City of Hugo entered into a Joint Powers <br />Agreement dated January 22, 1996, establishing a storm sewer improvement <br />district for the watershed of School Section Lake, Plaisted Lake, and Goggins <br />Lake; and <br />WHEREAS, a report prepared by the civil engineering firm of Montgomery <br />Watson, dated August 1996, determined the feasibility of establishing an outlet <br />from the basin to Brown's Creek for the purpose of reducing the flood waters; and <br />WHEREAS, a report prepared by Montgomery Watson, dated December 1996, <br />demonstrated that the water elevation of the basin could be controlled through <br />such an outlet without adversely impacting the property owners, or environment, <br />downstream from the outlet; and <br />WHEREAS, construction of the outlet to Brown's Creek will require obtaining <br />drainage easements outside of the municipal boundaries of the Town of May and <br />City of Hugo; and <br />WHEREAS, with the dissolution of the Brown's Creek Water Management <br />Organization the responsibility for surface water management within the watershed <br />rests with Washington County; and <br />
