RESOLUTION 1990-41 <br />RESOLUTION ESTABLISHING AN ORDINANCE AND LICENSING <br />VIOLATIONS COMMITTEE AND PROVIDING RULES FOR <br />OPERATION OF SAME <br />WHEREAS, The City Council is desirous of providing for the fair and <br />uniform enforcement of all City ordinances and licensing, and <br />WHEREAS, The City recognizes the rights of both complaintant and the <br />individuals who are subject of a complaint to have their concerns properly <br />investigated and fairly reviewed by the City Council, and <br />WHEREAS, Chapter 230 of the Municipal Code provides penalties for <br />violation of regulatory provisions within the Hugo City Code, and <br />WHEREAS, it is often times difficult to balance the rights of all <br />individuals with regard to complaints and uniform enforcement of City <br />ordinances, and <br />WHEREAS, it is intended that the City Council enforce its zoning <br />ordinances to promote orderly development of various districts according <br />to their best use, and <br />WHEREAS, the Council is aware that when adopting an ordinance.. the <br />City can be liable for not enforcing a "police -power" measure contained in <br />it, and <br />WHEREAS, the City Council recognizes that its individual members may <br />be personally liable for knowingly violating City ordinances with regard <br />to enforcement of same, and <br />WHEREAS, public officials may be liable in cases where they are found <br />guilty of willful wrongdoing, and <br />WHEREAS, the general public has indicated its concern for the manner <br />in which the City ordinance violations have been investigated and enforced <br />in the past; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGOV <br />WASHINGTON COUNTY, MINNESOTA, That an Ordinance Enforcement and <br />Licensing/Violations Committee be, and hereby is established, and that its <br />rules for operation shall be as follows: <br />1. The Committee shall be made up of three individuals, one of which <br />shall be the Mayor, who shall serve as the chairperson, with the other <br />two being representatives of the City Council and Planning Commission, <br />as chosen by the City Council. <br />2. All complaints of possible ordinance or licensing violations shall be <br />filed in writing, and signed by the complaintant,, with said complaint <br />being directed to the Committee chairperson. <br />3. The Committee shall meet on-call, by its chairperson, to investigate <br />all complaints, and meet with all affected parties, as it relates to <br />compliance with City ordinances. <br />4. The results of the Committee's investigation shall be made in a formal <br />
