Motion Carried. <br />APPEAL FILED BY TERRY MILLER W/LAWSUIT AGAINST CITY DBA (ONEKA LAKE <br />DEVELOPMENT) <br />Last Friday, January 20, 2006, City staff received a formal appeal filed by Terry Miller in his lawsuit <br />against the City for the Joyce Seever property, which was ruled in the City's favor by Judge Schurrer. <br />Mr. Miller waited until the final day on which make his appeal on his lawsuit against the City thereby <br />adding several months to the lawsuit appeal process, which will not be heard by Judge Schurrer until late <br />summer. City Attorney Dave Snyder formally presented Council with the formal appeal and the <br />proposed action by the City and an official response. No formal Council action was taken. <br />SITE INSPECTION VISIT W/WASHINGTON COUNTY RE: SNOWMOBILE SAFETY ON <br />CSAH 57 <br />At its November 7, 2005 meeting, Council discussed the snowmobile trail application submitted by the <br />Hugo Snowmobile Club for the four trails in and around the City. Council member Haas requested that <br />staff take a look at the trail along CR57, in front of resident Larry Ehret, in regard to snowmobile traffic <br />that travels along the side of the road along Larry's farm. Club president John Udstuen was present and <br />discussed with Council his meeting with Larry in regard to this issue, which he felt his concerns were <br />properly addressed by the club. Council directed staff to work with Washington County to investigate <br />whether or not there was anything that could be done with the sleep slopes. On January 11, 2006, Senior <br />Engineering Technician Scott Anderson and City Administrator Mike Ericson met on site, with Assistant <br />County Engineer Wayne Sandberg and Supervisor Nick Young, to determine whether there was anything <br />that could be done in regard to the trail. Staff concurred with county officials that the current trail <br />alignment satisfactorily serves the snowmobile club needs, since there is not an opportunity to move the <br />trail on the east side which has very steep slopes, as outlined in Washington County's letter of January <br />17, 2006. <br />Miron made motion, Haas seconded, directing staff to provide Larry Ehret with a copy of the County's <br />January 17, 2006 letter, apprising him of the Council's efforts, and include a copy of said letter in the <br />CR57 road condition file. <br />All aye. Motion Carried. <br />DISCUSSION ON DEL WEBB NEIGHBORHOOD COMMUNITY CONCEPT PLAN <br />At its January 12, 2006 meeting, the Hugo Planning Commission considered a concept plan presented by <br />Del Webb for a neighborhood community located on the east side of TH61 for the Riopel, Aplikowski, <br />and Arcand properties. This 369 -acre neighborhood proposal includes an active senior neighborhood <br />development, which would include 975 housing units, as well as an extensive trail system connecting the <br />neighborhood to the City's Bernin Park and a community center for senior activities. City Planner <br />Kendra Lindahl and Todd Baumgartner, representing Del Webb, presented the concept plan to Council <br />
