Motion Carried. JANUARY 14.2005 JOINT MEETING WITH THE RICE CREEK WATERSHED DISTRICT At its December 20, 2004 meeting, Council discussed the actions of the RCWD at its December 15, 2004 meeting. Council affirmed its desire to meet with the RCWD Board of Managers on Friday, January 14, 2005 in order to discuss the Board's action relating to the Hardwood Creek/JD2 Rehabilitation Project, as well as the proposed Settlement Agreement for the JD2 Culvert Replacement Project. Council discussed at length the Board's decision and what needed to be discussed at the January 14'h joint meeting. Haas made motion, Puleo seconded, directing the City Attorney to send a letter to the Chair of the Rice Creek Board of Managers questioning procedural problems at their meeting of 12/15/04 and ask for clarification no later than their meeting of January 12, 2005. All aye. Motion Carried. Miron made motion, Puleo seconded, directing the City Attorney to begin a preliminary appeal to the Board's decision, at a cost not -to -exceed $5,000. All aye. Motion Carried. Miron made motion, Haas seconded, to create a subcommittee to set an agenda for the January 14, 2005 joint Council/RCWD meeting: Council members Granger and Puleo; PC Chair Dave Schumann; RCWD Manager and Hugo resident Jim Leroux; Water Resource Engineer Pete Willenbring; City Attorney Dave Snyder; and City Administrator Mike Ericson. In the event Council member Granger is unable to attend, Council member Haas will attend. All aye. Motion Carried. Puleo made motion, Haas seconded, to schedule a special City Council meeting for January 14, 2005 at 8:00 am to receive and discuss the report of the agenda -setting committee. All aye. Motion Carried. JD2 CULVERT REPLACEMENT PROJECT UPDATE At its December 6, 2004 meeting, Council discussed the proposed Settlement Agreement for the JD2 Culvert Replacement Project. After continued discussions with RCWD staff, City has been successful in securing an agreement where the City would take over the project completion expected in the spring 2005. Council was supportive of the proposed agreement and will discuss this issue with the RCWD Board of Managers at the joint meeting on January 14, 2005.
