City Council meeting of February 17, 2004 <br />Page 3 <br />Funds for the BCWD for acceptance of funds to the City to purchase the Don and Pauline Rice <br />property at 9497 14& Street. The Agreement is consistent with direction from the Federal Emergency <br />Management Agency (FEMA) as to the City of Hugo acting as the local government agency for <br />acceptance of matching funds from the BCWD, Washington County, and FEMA. Adoption of the <br />Consent Agenda approved the Cost Sharing Agreement for the Rice property. <br />Schifsky & Sons submitted pay request #2 for work completed to date on the BEIP 5,' Addition <br />project. Project Manager Jay Kennedy from WSB Engineers reviewed the request and found it to be <br />satisfactory for work completed to date on the project. Adoption of the Consent Agenda approved <br />payment in the amount of $8,265.57. <br />APPROVE REDUCTION IN THE LETTER OF CREDIT FOR VICTOR GARDENS 3RD <br />ADDITION (CPDC) <br />Contractor Property Developers Company (CPDC) requested reduction in the letter of credit being <br />held for the newly -constructed public and private improvements in the Victor Gardens 3r4 Addition. <br />Adoption of the Consent Agenda approved a reduction in the letter of credit being held for <br />public/private improvements in the Victor Gardens and Addition development to $95,531 for the public <br />improvements and $109,966 for the private improvements. <br />APPROVE REZONING FROM AG TO LONG-TERM AGRICULTURE (CHUCK HAAS) <br />At its February 12, 2004 meeting, the Hugo Planning Commission reviewed a request from Charles <br />Haas of 15500 Keystone Avenue to rezone his property from agriculture to long-term agriculture. The <br />PC unanimously approved the application request. <br />Miron made motion, Granger seconded, to adopt ORDINANCE 2004-385 AMENDING CHAPTER <br />320 TO RECLASSIFY PROPERTY LOCATED AT 15500 KEYSTONE AVENUE FROM AG TO <br />LONG-TERM AGRICULTURE FOR A PERIOD OF EIGHT YEARS. <br />VOTING AYE: Granger, Petryk, Miron <br />ABSTAINED: Haas <br />Motion Carried. <br />REQUEST TO WASHINGTON COUNTY FOR VARIANCE OF RIGHT-OF-WAY <br />ACQUISITION POLICY <br />City staff has been working on the CSAH 8/14 Project Management Team (PMT) for more than two <br />years. Since administrative law judge Kathleen Sheehy allowed for a railroad crossing to be built at <br />143rd Street, staff has proceeded with completion of the design work for the project. Additionally, <br />Washington County officials requested that the City submit a formal application for a variance to its <br />current right-of-way acquisition policy. As Council is aware, current county policy states that cities <br />are responsible for all right-of-way acquisition costs for county road projects. However, the <br />
