City Council meeting of February 5, 2001 <br />Page 11 <br />for $134,000 with relocation costs of $11,004, for a total acquisition of $145,000. Additionally, staff <br />agreed with the Williams's request for an approved site location to park their RV, and authorize up to <br />six months of storage for their belongings. Staff further recommends that Council direct the City <br />Attorney to finalize the Purchase Agreement papers, and authorize and direct the Finance Director to <br />make.thery internal fund transfers to <br />Miron made motion, Haas seconded, to accept staffs recommendation and direct the City Attorney to <br />finalize the Purchase Agreement papers, and authorize and direct the Finance Director to make the <br />necessary internal fund transfers to fund this acquisition. <br />All aye. Motion Carried. <br />RECOMMENDATION TO PURCHASE HOUSE (a, 14621 FITZGERALD AVENUE <br />Staff has negotiated with Joe and Quentin Marier for the purchase of their land and building located at <br />14621 Fitzgerald Avenue. Staff recommends Council approve the purchase of the land and building for <br />$146,875. Staff finther recommends that Council authorize the City Attorney to finalize the Purchase <br />Agreement, including the friendly condemnation of the property for tax purposes, if necessary. Motion Carried. <br />REQUEST FROM TIM LEBA FOR REEVIBURSEMENT OF ATTORNEY FEES FOR ROAD <br />EASEMENT IN DUCK PASS <br />City staff has been in contact with Tim Leba who owns the. property at 8390 13d Street, in the Duck <br />Pass subdivision. There was a road constructed more than six years ago on his property for which he <br />claims an easement has not been obtained. Mr. Leba requested that the City prepare an easement for <br />recording, and have the City pay his attorney fees for review of the easement. City Attorney Dave <br />Snyder and Community Development Director John Rask requested that this issue be placed on the <br />agenda for discussion by the Council, and provide Mr. Leba an opportunity to formally address the <br />Council. Mr. Leba did not appear at the meeting. <br />Miron made motion, Puleo, that the Council direct staff to prepare the necessary easement and <br />reimburse Mr. IAa for his attorney fees in an amount not to exceed $100. <br />All aye. Motion Carried. <br />
