MINUTES FOR THE CITY COUNCIL MEETING OF MAY 16, 2000 <br />Mayor Walter Stoltzman reconvened the Council meeting of May 15, 2000 at 7:00 pm. <br />PRESENT: Barnes, Haas, Leroux, Petryk, Stoltzman <br />City Administrator, Mike Ericson <br />City Attorney, Dave Snyder <br />City Engineer, Dave Mitchell <br />City Clerk, Mary Ann Creager <br />BALD EAGLE INDUSTRIAL PARK 4TH ADDITION — DEVELOPMENT AGREEMENT <br />The developer disagrees with the storm water ponding fees calculated by the City's Water <br />Resource Engineer, Pete Willenbring. The City Attorney outlined three options available to <br />resolve the disagreement. After a lengthy discussion of the options: <br />Barnes made motion, Haas seconded, that the Development Veement be modified to permit the <br />City to reexamine its storm water ponding fees for the BEIP 4 Addition. In the event the Jackson <br />family does not accept the final calculation, the parties would go into binding arbitration. The <br />Development Agreement shall also be subject to the seven conditions outlined in the City <br />Attorney's memo of May 12, 2000. <br />All aye. Motion Carried. <br />PARKING AT SUBWAY — RICHARD GRANGER <br />The owner/operator of the Subway located at 147h Street and TH61 has agreed to allow bike trail <br />users to use his parking area and restroom facilities in exchange for Washington County moving <br />the fencing in front of establishment to allow for customer parking. The Council was in agreement <br />that they had no objection to this arrangement. <br />Stoltzman made motion, Petryk seconded, that a letter be forwarded to County Commissioner, <br />Dennis Hegberg, stating that Hugo has no objection to the County working with Subway to provide <br />parking facilities for bike trail users in exchange for parking in County right-of-way. Landscaping <br />shall be placed at site after removal of the fence. <br />All aye. Motion Carried. <br />GREENE AVENUE RESTORATION <br />The City Engineer was contacted by three residents regarding their interest in concrete curb and <br />gutter for the east side of Greene Avenue. Because 100% of the improvements would not be paid <br />by benefiting property owners, the restoration of the Greene Avenue will proceed along as <br />previously agreed. <br />PURCHASE OF BERNIN PROPERTY <br />Council member Barnes has developed a draft offer for purchase of the Bernin property one Greene <br />Avenue. The City Attorney suggested that Bob Briggs of his office draft a formal agreement using <br />Council member Barnes' guidelines. <br />
