MINUTES FOR THE HUGO CITY COUNCIL MEETING OF JULY 12, 1999 <br />Mayor Stoltzman reconvened the meeting of July 6, 1999 at 7:00 pm. <br />PRESENT: Barnes, Haas, Leroux, Petryk, Stoltzman <br />City Administrator, Robert Museus <br />City Engineer, Tom Angus <br />City Clerk, Mary Ann Creager <br />ADDITIONS TO AGENDA <br />Creekview Preserve 2nd Addition <br />Greene Avenue Road Improvements <br />Letter from Park Commission <br />"Cat" Meeting with DNR <br />PURCHASE AGREEMENT (NORTH COUNTRY AUTO BODY) <br />The Council considered an Agreement between the City of Hugo and North Country Auto Body for the <br />acquisition of additional road easement along 140th Street for the City, and the sale of Outlot B of the <br />BEIP to North Country. Because Council member Barnes had a number of questions regarding the <br />Agreement and the City Attorney was not present: <br />Barnes made motion, Leroux seconded, to table this matter until the Council meeting of July 19, 1999. <br />All aye. Motion Carried. <br />ARK AUTO RECYCLING LICENSE <br />Mr. Dan Stewart dba ARK, Inc., is in violation of fiis license to operate a recycling business at 16813 <br />Forest Blvd North: <br />1. He has not provided the City a site survey prepared by a registered land surveyor, as required by <br />paragraph A of the license. <br />2. He has not provided the City with a parking plan in accordance with paragraph B of the license. <br />3. He has not constructed a 3' high berm topped by coniferous trees along the north property line, as <br />required by paragraph H of the license. <br />Mr. Daniel Rosen, an attorney representing Mr. Stewart, had requested a three-week extension of the <br />June 1, 1999 deadline to prepare these items, which has since lapsed. The Council reviewed the license, <br />as well as the District Court's Stipulation Agreement. Councilman Haas stated that staff should make <br />sure ARK's $20,000 letter of credit not be allowed to expire. <br />Haas made motion, Leroux seconded, that the City honor the District Court's Stipulation and Order, as <br />the terms specified in the decree have not been met by the defendant, Mr. Daniel Stewart. <br />All aye. Motion Carried. <br />
