City Council meeting of August 9, 1999 <br />Page 3 <br />for the development of 185 townhouse units on approximately 40 acres of property located in the <br />northeast quadrant of the intersection of 130th Street and Fenway Blvd. This matter was subject to a <br />public hearing before the PC at their meeting of July 28, 1999, and recommended granting the PUD and <br />preliminary plat subject to Findings and Conditions. At the request of Ernest Peake, attorney for the <br />development: <br />Stoltzman made motion, Leroux seconded, to table until August 16, 1999. <br />All aye. Motion Carried. <br />ONEKA LAKE VIEW EAST (LANDSCAPING PLAN) <br />Based on Council direction, the City Engineer prepared a revised landscaping plan for the area between <br />Oneka Lake Blvd and Glenbrook Avenue, lying within the Oneka Lake View East subdivision. <br />Councilman Haas was dissatisfied with the latest proposal and suggested that a 3' to 3 1/2' raised bed <br />masonry block, along with planting, be approved. The landscaping is needed to block headlights from <br />the house across the street. The homeowner was satisfied that this would resolve his concerns. <br />Haas made motion, Stoltzman seconded, that the cul-de-sac between Oneka Lake Boulevard and <br />Glenbrook Avenue, in the Oneka Lake View East subdivision, be landscaped with 3' to 3 1/2' raised bed <br />construction of Versalock or similar masonry for a length of at least 60 ft or longer. Eight 6 ft tall <br />spruce to be planted in bed, and if necessary, landscaping arborvitae to provide screening. <br />All aye. Motion Carried. <br />NOISE ORDINANCE <br />The City Attorney prepared a draft ordinance to regulate construction activities and limit their adverse <br />affect on adjacent property owners. <br />Stoltzman made motion, Haas seconded, to schedule a public hearing for September 7, 1999, at 7:05 <br />pm, to consider adoption of an ordinance regulating emanation of certain noise pollution with the City. <br />VOTING AYE: Haas, Petryk, Stoltzman <br />VOTING NAY: Leroux <br />Motion Carried. <br />MORATORIUM ORDINANCE <br />Based on two previous court decisions, the City Attorney, Dave Snyder, determined that the moratorium <br />ordinance passed with a 3/5's vote on August 2, 1999, and recommended that the City Clerk be directed <br />to have the ordinance published. <br />Stoltzman made motion, Petryk seconded, accepting Attorney Dave Snyder's findings, and directing the <br />City Clerk to have Ordinance 1999-334 published in the City's legal newspaper. <br />
