City Council meeting of February 17, 1998 <br />Page 2 <br />SITE PLAN APPROVAL (17285 FOREST BLVD.) <br />Susan and Glen Kothe, 9056 W. Broadway, Forest Lake, MN., applied for site plan <br />approval to use an existing building for a retail pet supply business at 17285 Forest Blvd. <br />The property is zoned for retail business. The site plan shows 75 available parking spaces <br />which is compliance with ordinance, though all the area is not currently improved with <br />paved surface. The City Code 219-6 requires that where more than four (4) parking <br />spaces are required, asphalt, concrete, or other surface water sealed shall be used. Staff <br />recommended approval of the site plan subject to the property owner complying with the <br />City's parking and loading regulations. Adoption of the Consent Agenda approved the <br />site plan, as conditioned. <br />WATER METER REPLACEMENT LETTER <br />The Council considered a letter to those residents who have not yet arranged for the <br />placement of a new water meter in their residence or business. Adoption of the Consent <br />Agenda approved the letter for mailing. <br />PUBLIC P"ROVEMENT HEARING (FENWAY BLVD/AVENUE) <br />A public hearing was called to consider making improvements to Fenway Boulevard, from <br />130th Street to 140th Street, and to Fenway Avenue, from 140th Street to 142nd Street. <br />The proposed improvements include sanitary sewer, municipal water connection, curb, <br />gutter, storm sewer improvements, and street paving. The Engineer's cost estimate for <br />Fenway Boulevard is $1,668,900, and for Fenway Avenue, $268,300. Because the benefit <br />analysis and proposed assessment roll for the project were not available for the meeting, <br />the City Administrator recommended that tonight's discussion to be limited to project <br />construction only. The public hearing was opened for discussion of the Fenway Avenue, <br />from 140th Street to 142nd Street. Paul Delarosa, 14194 Ferrara, stated that at the time <br />he purchased his lot, he was not aware of any proposed improvements to Fenway Avenue. <br />He was concerned with increased traffic, and potentital danger to the many children living <br />on the street. Steve Huberty, 14172 Ferrara, stated that everyone was against the project, <br />and submitted a petition with eleven signatures disagreeing with the project. Property <br />owners stated that if they had known about the easement, that they would not have <br />purchased their lots. Property owners questioned whether concerns were given as much <br />consideration as the property owner interested in developing his property. Discussion <br />continued with the Fenway Boulevard project, between 130th Street and 140th Street. <br />The Jackson family was present, with Judd and Tom addressing the Council regarding <br />their property. Tom Jackson presented his version of the feasibility for the project, and <br />asked that the City acknowledge that they "promised" to build Falcon and Fenway Avenue <br />without assessment to them, and in return, they would drop their lawsuit against the City. <br />The Council indicated that Falcon Avenue was discussed, but that this was not part of the <br />final agreement for the project. <br />
