City Council meeting of April 13, 1998 <br />Page 2 <br />DEVELOPMENT COVENANTS <br />The Council reviewed the proposed Development Covenants for businesses constructing <br />and locating in the expanded Bald Eagle Industrial Park. Staff was directed to add a <br />paragraph allowing flexibility in site design through a Planned Unit Development (PUD) <br />process, and a paragraph relating to management rail service in the Park and review the <br />driveway requirements for compliance with City ordinance. <br />Pete Willenbring provided the Council with a report on the results of the Environmental <br />Assessment Worksheet prepared for the Bald Eagle Industrial Park. A review of <br />submittals from interested government agencies and individuals indicated that there would <br />be no significant environmental affects from the proposed project, and Mr. Willenbring <br />recommended that the Council adopt Findings stating that there is no need for an <br />Environmental Impact Statement for the Bald Eagle Industrial Park. <br />Barnes made motion, to adopt Findings of Fact prepared by Mr. Willenbring and a <br />Statement of Negative Need for an EIS for the Bald Eagle Industrial Park. The City <br />Administrator is directed to provide the Environmental Quality Board a report on the <br />Council's findings. <br />All Aye. Motion Carried. <br />Mr. Willenbring then described the storm water management component of the Industrial <br />Park improvement project, including the construction of large holding ponds along the <br />floodplain of Clearwater Creek. <br />Miron made motion, Leroux seconded, to name the 80 acres of property the City owns <br />along Clearwater Creek, south of 140th Street, Clearwater Creek Environmental Preserve. <br />All aye. Motion Carried. <br />Tom Angus, City Engineer, explained the platting process for the Industrial Park <br />expansion. <br />Miron made motion, Barnes seconded, to direct the City Engineer to prepare a plat for the <br />Bald Eagle Industrial Park expansion, and to apply for plat approval. <br />All aye. Motion Carried. <br />Mr. Angus stated that the Fenway Boulevard project is in design, and that there were <br />some issues regarding wetlands delineation and defining the drainage easement across the <br />Tschida property yet to be resolved. <br />
