Adoption of the Consent Agenda approved delaying <br />construction of the mound system until June 15, 1999. <br />CHARITABLE GAMBLING LICENSE (HUGO FIRE RELIEF ASSN) <br />The Hugo Fire Relief Association applied for a MN Lawful Gambling Permit to sell <br />pulltabs at the End Zone Bar and Grill, 13891 Forest Blvd, Hugo, MN. Proceeds from the <br />pulltab sales will be used to fund the Fire Department's capital equipment fund. In <br />addition, the Association will need to acquire start-up money to initially purchase pulltabs <br />an provide a "kitty" for the payment of winning tickets. They requested that the City <br />`front" them $10,000 to start this operation. Adoption of the Consent Agenda approved <br />the Premise Permit Application for the Fire Relief Association, as well as a $10,000 loan <br />from the City's general fund to Fire Relief Association, be to be repaid from charitable <br />gambling proceeds. <br />PRELEWWARY PLAT (CLEARWATER CREEK PRESERVES) <br />Mr. George Indykiewicz, 1920 W. Highway 96, Arden Hills, and the Backes Company, <br />7026 Brooklyn Blvd, requested preliminary plat approval for the development known as <br />Clearwater Creek Preserves located on approximately 165 acres along the west side of <br />TH61, in the NE 1/4 of Section 17. The applicants are requesting 220 single family lots <br />on the property. This matter was considered by the Planning Commission at their meeting <br />of April 22, 1998, at which time they recommended approval of the preliminary plat <br />subject to the Findings of Fact and Recommendations provided to the Council previously. <br />Jeff Shopek, project engineer, reviewed the revised plan, along with discussion of <br />responsibility for ponds to be located on the property. The Council agreed that a <br />homeowners' association should be formed for this development to address pond <br />maintenance, and that the Fire Chief should review the project to determine if a temporary <br />second access should be required for emergency services. <br />Leroux made motion, Goiffon seconded, to approve the preliminary plat for <br />CLEARWATER CREEK PRESERVES subject to the City's Water Resource Engineer, <br />Pete Willenbring, review of drainage for the project, and comments from the Fire Chief as <br />to the need for a second access to the site. Any changes to be incorporated into the <br />Findings of Fact and Recommendations. <br />Leroux made motion, Goiffon seconded, to amend the previous motion to include <br />requirement that a homeowners' association be formed to control the outlots (ponds). <br />VOTE ON AMENDMENT: All aye. Motion Carried. <br />VOTE ON ORIGINAL MOTION: All aye. Motion Carried. <br />Miron made motion, Leroux seconded, to adopt ORDINANCE 1998-321, AN <br />ORDINANCE AMENDING THE ZONING ORDINANCE TO CHANGE THE <br />ZONING CLASSIFICATION OF THE DESCRIBED REAL PROPERTY. <br />All aye.
