City Council Minutes - June 3, 1996 <br />Page 2 <br />financial statements materially reflect the condition of the City and <br />summarized that the City was in a good financial condition. Several <br />suggestions were made by Linda Grautman including: <br />1. Collecting a larger deposit from developers to cover City costs in <br />project review and inspection, so as not to be in a deficit situation. <br />2. Include on invoices where the funds are being spent. <br />3. Encourage the Washington County Public Works Dept. to be more timely <br />and specific in the bills for road maintenance workâ˘. submitted to the <br />City. - <br />Motion made by Leroux, seconded by LaValle to accept the 1995 Audit <br />Report. <br />All aye. Motion carried. <br />REZONING (MCELMURY) <br />Mr. Robert McElmury, owner of Bobber's Boats and Bait, 4444 129th Street, <br />has requested to rezone his property from the current SFE/Conservancy <br />classification to Retail Business in order to expand his business to <br />include ice house rental, additional storage, and additional retail sales <br />on the site. Mr. McElmury stated that the City's draft comprehensive plan <br />reflects the need for additional recreational areas in Hugo, which is whai <br />he is proposing to provide. Attorney Galler stated that the Special Use <br />Permit signed by Mr. McElmury waived all rights for nonconforming use and <br />expansion of the business. <br />Motion made by LaValle, seconded by Barnes, to deny the rezoning request <br />of Robert McElmury to rezone .6 acres from SFE/Conservancy to Retail <br />Business based on the Findings of Fact prepared by Attorney Galler. <br />All aye. Motion carried. <br />Jim Kellison requested the record show he was not given an opportunity;, to <br />speak regarding the McElmury request, and that he opposes any <br />encouragement by the Council to Mr. McElmury for his reapplication for an <br />Amended Special Use Permit. <br />REZONING REQUEST (CITY_OF HLGO) <br />The City of Hugo requested a minor subdivision and rezoning of one acre <br />from a 42.47. acre parcel, owned by the City, adjacent to T.H. 61 and north <br />of Flay Avenue. This is to allow for the construction of a new post <br />office for the community. Bernard Brunotte stated that this was clearly, <br />"spot zoning" and strongly opposes the post office being located on that <br />site. <br />Motion made by Barnes, seconded by LeroUb.. to adopt ORDINANCE 96-310, AN <br />ORDINANCE AMENDING CHAPTER '2C? OF THE HUGO CITY CODE ENTITLED "ZONING" BY <br />AMENDING THE ZONING CLASSIFICATION OF THE DESCRIBED REAL PROPERTY. <br />'DOTING AYE: Barnes, Goiffon, LaValle, LeroUX, Miron <br />Motion Carried. <br />
