City Council meeting of October 21, 1996 <br />Page 2 <br />RESOLUTION APPROVING THE DISSOLUTION OF THE BROWN'S CREEK <br />WMO <br />The Minnesota Board of Soil and Water Resources has declared that the Brown's Crack <br />WMO has failed to implement its plan for the management of storm water within the <br />Brown's Creek watershed. This is the first step in legally dissolving the WMO. The <br />Council considered a resolution requested by the Washington County Soil and Water <br />Conservation District approving the dissolution of the Joint Powers Agreement which <br />created the Brown's Creek WMO. The WCSWC service feels that this is the most direct <br />method in resolving the dissolution of the WMO in preparation for reassigning the <br />responsibilities for storm water management in the area. Staff recommended approval of <br />the resolution. <br />Barnes made motion, Goiffon seconded, to adopt RESOLUTION 96-11, A <br />RESOLUTION APPROVING THE DISSOLUTION OF THE BROWN'S CREEK <br />WATERSHED MANAGEMENT ORGANIZATION. <br />VOTING AYE: Agness, Barnes, Goiffon, Miron <br />Motion Carried <br />ED LIOUOR LICENSE VIOLATION <br />It is alleged that on March 2, 1996, a bartender in the employ of Mr. Raymond Bogatty, <br />doing business as Ricci's Cantina in Hugo, served alcohol to a minor in violation of the <br />City's liquor licensing ordinance. On April 15, 1996, the City Council approved the City <br />entering into a Stipulation Agreement with Mr. Bogatty in lieu of conducting a disciplinary <br />hearing on the alleged violation under Hugo City Code, Chapter 150, Section 12. Mr. <br />Bogatty has indicated his unwillingness to enter into the Stipulation Agreement, and staff <br />recommended that the Council conduct a hearing on the violation on November 18, 1996. <br />Barnes made motion, Goiffon seconded, directing City staff to schedule a hearing for <br />November 18, 1996, at 7:05PK to discuss an alleged violation of the City's liquor <br />licensing ordinance by the selling of alcohol to a minor at Ricci's Cantina. <br />All aye. Motion Carried. <br />1996 ROAD GRAVELING CONTRACT <br />Three bids were received by the City for the proposed 1996 road graveling project. Staff <br />recommended that the City purchase the material from the low bidder, Forest Lake <br />Contracting, at their bid price of $3.98 per ton. Total project cost is expected to be <br />$11,836.20. <br />Goiffon made motion, Agness seconded, to accept the low bid of $3.98 from Forest Lake <br />Contracting, for the 1996 road graveling project. <br />All aye. Motion Carried. <br />
