Planning Commission Minutes — June 13, 2013 <br />Page 2 <br />East and the City's Comprehensive Plan and recommends approval of the PUD Amendment for <br />Diamond Point East. <br />McRoberts stated that this issue arose because the developer originally requested smaller lots and <br />therefore there is a lack of permitted space for decks. He questioned why not just make the lots <br />larger by extending the lot lines to the middle of the development. Juba stated that the smaller <br />lots help protect the wetlands. <br />Developer, Mike Quigley stated that yes, the lots are smaller but they are still designed to <br />maintain separation. It was not intentional that some lots would not have enough permitted <br />space, but it is a result of trying to maintain the openspace areas. <br />Chairman Gwynn opened the Public Hearing. <br />Jennifer Durand (6670 1450 Alcove) stated that they were not made aware of the setback when <br />they built. Both her and her neighbors would appreciate the approval of the PUD Amendment so <br />that they would be able to enjoy their backyards. <br />Chairman Gwynn closed the Public Hearing. <br />Arcand made a motion, Lessard seconded, to approve the Planned Unit Development <br />Amendment for Diamond Point East as presented. Staff will present at the July 1, 2013 City <br />Council Meeting for final approval. <br />All Ayes, motion carred. <br />Preliminary Plat and Final Plat for Roy Molitor 21d Addition — Xcel Enernv Inc. <br />City Planner, Rachel Juba, presented to the Planning Commission a request from Xcel Energy <br />for a preliminary plat and final plat for the property located south of 140"' Street and west of <br />Fenway Boulevard. The preliminary plat and final plat will subdivide a 46 acre piece of property <br />into 1 lot (15.6 acres) and 1 outlot (30.4 acres) to be known as Roy Molitor 2nd Addition. <br />Juba stated that the City Council approved the final plat for Roy Molitor 1 st Addition in 2011 and <br />that the lot that is being subdivided is known as Outlot A, Roy Molitor I" Addition. if the <br />proposed plat meets the standards outlined in the City's Comprehensive Land Use Regulations, <br />then the City must approve the plat. The proposed plat meets the lot size, setback, streets and <br />access, drainage and grading, utilities and park dedication requirements. With the application <br />meeting all requirements necessary to approve the preliminary plat and final plat for the Roy <br />Molitor 2nd Addition staff recommends approval of the preliminary and final plat. <br />McRoberts questioned what the motivation was behind this request from Xcel Energy. <br />Lynn Patzner, a representative from Xcel Energy, stated that when Xcel originally purchased the <br />property from the Molitor family there was a condition in the agreement that Xcel needed to <br />
