Planning Commission Minutes — October 14, 2010 <br />Page 2 <br />Len Pratt, the Developer, addressed the Planning Commission. He apologized for the sign being <br />in the wrong location and to the Heritage Ponds Association for that. He stated that he told Mink <br />Homes to put up the sign but wasn't clear where to put it and about the process for the IUP. <br />Rosenquist asked about the sign maintenance. <br />Len Pratt assured the Planning Commission that they would fix the sign, and added that the sign <br />must be working because they were able to build two homes already and have sold two other lots <br />in the development. <br />Schumann closed the public hearing. <br />McRoberts stated that he would like to see a set termination date or event because the 90% could <br />take a long time to complete. <br />Rachel answered that the Planning Commission Could add a date to the motion. <br />McRoberts Motioned, Moore seconded, to approve the IUP request with additional language that <br />the permit would have a 3 year termination date, and could be reapplied for after such time. <br />All Aye, motion carried. <br />Variances <br />Community Development Director, Bryan Bear, gave an update to the planning commission on <br />the recent supreme court ruling regarding variances. He explained that a majority of the <br />variances are seen at the Board of Zoning, however the Planning Commission should be familiar <br />with the ruling because they would see variance requests when they are along with site plans and <br />subdivisions. <br />Adjournment <br />McRoberts motioned, Moore seconded, to adjourn. <br />All Ayes.
