Planning Commission Minutes — April 24, 2008 <br />Page 3 <br />create impacts. <br />Staff recommended approval of rezoning, preliminary plat, site plan, and variance. <br />McRoberts and Schumann raised questions concerning the proposed storm water ponds, their <br />flows through the area, and whether the engineering could handle the overages in a large rain <br />event. <br />David Hempel ensured the commission that both quality and quantity of stormwater are <br />addressed. He also stated that they have dealt with Xcel issues in other parts of Victor Gardens, <br />and this was not something of concern. <br />Chairman Schumann opened the Public Hearing. <br />Richard Meath of 15128 Everton Ave N stated that he was concerned about the drainage from <br />his property south to this land and would like to meet with the Engineers and Rice Creek <br />Watershed Districts to go over the plan and answer his questions regarding the impacts to his <br />property. <br />John Udstuen of 15190 Everton Ave N requested that the issue be tabled. He mentioned that <br />mistakes can happen and that he is concerned with the drainage. He would like to talk with the <br />Rice Creek Watershed District and engineers before this plat is approved. He stated that he has <br />been video taping the waterways through the proposed land, and wants to know that the <br />waterways will not be touched so they do not flood his land. He told the developers that he is <br />not opposed to the development, but would like the drainage issues address before it is approved. <br />Arnold Triemert of 15220 Everton Ave N was concerned with the amount of wetlands in the <br />area. He wanted to know whether they were intending to reroute the waterway. He also <br />mentioned that there is a septic system very close and wanted to know the concerns regarding <br />water quality issues. He also wanted to meet with the RCWD and engineers to address the issue. <br />Dave Hempel stated that the RCWD and City Engineers both need to approve the areas and plans <br />before the development can take place and the people should expect very minimal impacts with <br />exception to Rosemary Way that will need culverts. He also stated that there are emergency <br />overflows on the concept plan. They will meet and or exceed the drainage needs for the area. <br />Bryan Bear explained that he and the City Engineer will meet with residents. Developers are <br />welcome to attend the meeting as well. Bryan was not suggesting the application to be <br />postponed. <br />Chairman Schumann Closed the Public Hearing. <br />Dave Hempel passed out some changes to the preliminary plat and site plan resolutions to the <br />commission and staff. <br />Schumann asked for clarification of changes from Kendra. Staff and developers had many <br />disagreements on changes made. <br />
