Planning Commission Minutes — February 12, 2004 <br />Gene's Disposal — CUP and Variance <br />The Commission held a public hearing to consider the request of Gene Wegleitner, owner <br />of Gene's Disposal Service, Inc., for a Conditional Use Permit to allow a recycling center <br />and for exterior storage exceeding the size of the principal structure. The exterior storage <br />would be used for storing rolloffs and for sorting material. Also requested was a variance <br />from the paving requirements. <br />The property is located at 5661 152nd Street North (Peloquin Industrial Park) and is part <br />of the former site of American Structural Metals. On the property is an existing building <br />approximately 10,840 square feet in size. <br />The applicant indicated that he wanted to purchase the property and use the front half of <br />the building for storage and office, and rent out the rear portion of the building to another <br />user. <br />Staff recommended approval of the Conditional Use Permit but denial of the variance <br />from the paving requirements because it did not meet the standards required in the <br />Comprehensive Land Use Regulation. <br />Chair Schumann opened the public hearing. There was no one present but the applicant. <br />Schumann closed the public hearing. <br />Commissioner Hoffbeck asked the applicant why he was requesting the variance and the <br />applicant indicated that it was because of the high cost associated with paving the entire <br />parking and storage area. <br />The applicant said there was a mesh screening used to cover the rolloff containers. <br />Malaski said she did not feel it was an appropriate cover to contain the odors. The <br />applicant said the refuse would only be there for a short time. <br />Commissioner Bailly said she felt the paving of the exterior area was necessary and the <br />south part of the lot could remain gravel if it wasn't going to be used. <br />Commissioner Kleissler asked how the potential renter would access the building. The <br />applicant said the property could be accessed from Freeland Avenue. The Planner <br />indicated that there should be an easement over the property to the east for that access. <br />It was noted that any additional new tenants would be required to apply for a conditional <br />use permit if necessary. <br />The applicant asked to work with staff on paving and parking issues. <br />Malaski made motion, Bailly seconded, to recommend approval of the Conditional Use <br />Permit for recycling and exterior storage, and recommend denial of the variance from the <br />paving requirement. <br />All Ayes. Motion carried. <br />
