Planning Commission Meeting May 8, 2003 page 2 <br />Keiger Amended Conditional Use Permit <br />The Commission held a public hearing to consider the application of Kieger Family Limited <br />Partnership, 5609 Turtle Lake Road, Shoreview, to amend the existing Conditional Use Permit for <br />5885 165th Street North to allow a garden center and landscape supply business on the property. <br />The Community Development Director explained that Keiger Enterprise currently had a Conditional <br />Use Permit for an environmental clean-up business, including vehicle repair facilities, cold storage, <br />exterior storage of vehicles and equipment, and company offices. It was noted that Kieger had <br />relocated their business, and activity on the present site had decreased. <br />Pat Iwan, manager of the landscape business, was present at the meeting. <br />Malaski opened the public hearing. <br />Cathy and Rick Suess, 5725 165th Street North, said she had spoke to Mr. Iwan and work had been <br />done all weekend to build a berm and plant evergreen trees. Mrs. Suess said they had done an <br />excellent job to buffer their property and she commended their cooperation. She had issues with them <br />being open on Sundays and all year long. The Suesses stated that there was a lot of noise at all hours <br />coming from the site. <br />Schumann suggested Sunday hours be limited to noon and the other uses of the property be removed <br />from the Conditional Use Permit. Malaski said that most landscape companies are open until 5:00 <br />pm. <br />Dave and Pam Ochs, 5756 165th Street North, said they don't mind the landscaping business being on <br />the site but they do have a problem with early hours. They said they are still hearing noises at 4:00 <br />a.m. <br />Mr. Ochs said Mr. Iwan paid him a visit and left his home abruptly after using inappropriate <br />language. <br />Mrs. Ochs said that the noise occurs so regularly that she did not want to call the police each time. <br />Schumann said it might be difficult to determine which business it was coming from. <br />Iwan said that, to the best of his knowledge, there should be no one on the property after hours. <br />There were no other comments and Malaski closed the public hearing. <br />Bailly asked if the regular hours could be adjusted on the Conditional Use Permit and the Community <br />Development Director said they could. <br />Rosenquist suggested a starting time of 7:00 am. <br />It was noted that other types of business were operating on the site and Schumann said he felt that <br />several people on one permit could be problematic. <br />
