Planning Commission Meeting September 11, 2003- page 2 <br />The City updated the zoning map for the entire City in 1999. In review of City records and <br />Planning Commission and City Council minutes, staff found no specific mention of the rezoning <br />that occurred in the downtown area. <br />Tom Zeller, 5455 145th Street North, asked if the Railroad had approved the crossing for the <br />County Road 8 realignment. Schumann stated that they were negotiating with Burlington <br />Northern Sante Fe regarding the project. Zeller also asked if a non -conforming lot could be <br />rebuilt on if it could not meet the setbacks and Schumann replied that it could be rebuilt on the <br />same footprint. The CD director said that with the rezoning of the property, a variance could be <br />applied for, and under the current zoning, a variance would not be permitted. Zeller stated that he <br />felt they were being paralyzed by rezoning to residential should a developer want to buy it. <br />Schumann explained that the commercial zoning was not being taken away; instead, a residential <br />element was being added to it. <br />Carol Bernier Young, owner of a home on 146' Street with six other sisters, said they could sell <br />their home should the property be rezoned and wanted to know when the decision would be made. <br />The CD Director said that if the Commission made a recommendation that evening, it would go <br />to the City Council on September 15, 2003. <br />There were no other comments and Schumann closed the public hearing. <br />Rosenquist stated that he had no problems with the rezoning. <br />Schumann noted that some residents along Flay Avenue wished to go to residential zoning, and <br />the CD Director suggested that it be considered with the downtown redevelopment plan. <br />Malaski had concerns about neighbors reacting to future commercial uses. Schumann suggested <br />standards be set to ensure the commercial uses would be compatible with the residential area. <br />Rosenquist made motion, Malaski seconded, to recommend approval of the rezoning and text <br />amendment. <br />All Ayes. Motion carried. <br />Work Program for Downtown Plan Update <br />The CD Director explained the interactive process for revising the downtown plan saying the City <br />intended to notify property owners of upcoming meetings. <br />Schumann encouraged the Commission members to let the CD Director know of any ideas they <br />had for discussion of the downtown area. <br />The CD director explained that a joint meeting with the City Council would be held at the next <br />
