Nugent CUP Amendment <br />Page 3 <br />1. The proposed use is permissible by law. <br />The proposed accessory building is allowed by conditional use permit. <br />2. The proposed use is keeping with the spirit and intent of the ordinance. <br />The proposed motor vehicle repair business is consistent with the current general industrial <br />zoning classification, which is intended to encourage the development of industrial parks where <br />uses of varying types and scale of operations can be located. Such businesses may include, <br />office, distribution, light industrial, warehousing, wholesaling, and repair businesses. <br />3. The proposed use is compatible with the City's Comprehensive Plan and the character of the <br />surrounding area. <br />The use is consistent with the character of this general industrial zoning classification. The City's <br />Comprehensive Plan identifies this area as Industrial. The character of the area will not change <br />noticeably. <br />4. The proposed use has adequate drainage, water supply, electrical, gas, and sewage treatment <br />facilities. <br />All utilities are already connected and the drainage system is currently constructed. Staff does <br />foresee any problems with utilities or drainage. <br />5. The proposed use has adequate road access. <br />The use has adequate road access into Freeland Avenue from the property. <br />6. Technical Evaluation of Floodplain. <br />The applicant is not proposing to impact any floodplain. <br />7. The proposed use should not increase the potential for flood damage. <br />The proposed use would not obstruct the floodplain or increase the potential for flooding. <br />8. The proposed use will not damage or reduce the benefits the public receives from public <br />waters. <br />The proposed use would not damage or reduce the benefits from any public waters. <br />9. The use of watercraft on public waters. <br />The proposed use would not involve the use of watercraft on public waters. <br />10. All structures shall be screened from view of public waters. <br />
