Site Plan and Conditional
Use Permit Amendment for a 4,560 square foot building addition.
DATE: June 19, 2014 for the Planning Commission Meeting of June 26, 2014
COMPREHENSIVE PLAN: Public/Quasi-Public (PQ)
ZONING: Central Residential (CR -3)
REVIEW DEADLINE: July 20, 2014
1. DESCRIPTION OF REQUEST:
The applicant is requesting approval of a site plan and conditional use permit (CUP) amendment
for a building addition on the property located at 6000 148t11 Street North. The site plan is for a
4,560 square foot building addition to the 5,965 square foot church on the 6.36 acre parcel. A
CUP is required for a Place of Worship to be located in the Central Residential (CR -3) zoning
district and the amendment is required for the building addition. The property has several CUP's
for the church for the use, a preschool/daycare, a bell tower, and off-site directional signs. All of
the uses, except the church, are being conducted on the property. It is the applicants desire to
remove these uses allowed by prior CUP's. The CUP amendment will supersede all of the
existing CUP approvals.
2. BACKGROUND:
In addition to the City Code and Comprehensive Plan the City must comply with the federal law
known as the Religious Land Use and Institutionalized Persons Act (RLUIPA). The law protects
religious institutions from unduly burdensome and discriminatory land use regulations. A City
cannot impede on the ability of churches or other religious institutions to carry out their mission
of serving the religious needs of their members. A City would have to show a compelling reason
for imposing a regulation that may impede on the ability of the church or other religious
institution to carry out their religious mission.
