Site Plan and Conditional <br />Use Permit Amendment for a 4,560 square foot building addition. <br />DATE: June 19, 2014 for the Planning Commission Meeting of June 26, 2014 <br />COMPREHENSIVE PLAN: Public/Quasi-Public (PQ) <br />ZONING: Central Residential (CR -3) <br />REVIEW DEADLINE: July 20, 2014 <br />1. DESCRIPTION OF REQUEST: <br />The applicant is requesting approval of a site plan and conditional use permit (CUP) amendment <br />for a building addition on the property located at 6000 148t11 Street North. The site plan is for a <br />4,560 square foot building addition to the 5,965 square foot church on the 6.36 acre parcel. A <br />CUP is required for a Place of Worship to be located in the Central Residential (CR -3) zoning <br />district and the amendment is required for the building addition. The property has several CUP's <br />for the church for the use, a preschool/daycare, a bell tower, and off-site directional signs. All of <br />the uses, except the church, are being conducted on the property. It is the applicants desire to <br />remove these uses allowed by prior CUP's. The CUP amendment will supersede all of the <br />existing CUP approvals. <br />2. BACKGROUND: <br />In addition to the City Code and Comprehensive Plan the City must comply with the federal law <br />known as the Religious Land Use and Institutionalized Persons Act (RLUIPA). The law protects <br />religious institutions from unduly burdensome and discriminatory land use regulations. A City <br />cannot impede on the ability of churches or other religious institutions to carry out their mission <br />of serving the religious needs of their members. A City would have to show a compelling reason <br />for imposing a regulation that may impede on the ability of the church or other religious <br />institution to carry out their religious mission. <br />
