LEVEL OF DISCRETION IN DECISION-MAKING <br />The City's discretion in approving or denying a site plan is limited to whether or not the <br />proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If <br />it meets these standards, the City must then approve the site plan. <br />The City's discretion in approving or denying a conditional use permit is limited to whether or <br />not the proposed application meets the standards outlined in the Zoning Ordinance. If it meets <br />these standards, the City must approve the conditional use permit. <br />4. CONTEXT: <br />A. Surrounding Land Use and Zoning <br />The property to the north is zoned Low Density Multiple Family Residential (R-4) and is <br />occupied by the Twin Pines development. The properties to the east, south, and west are zoned <br />Central Residential (CR -3) are occupied by the Hugo Elementary School and single family <br />homes. <br />B. Natural Characteristics of Site <br />The property is generally flat. There are no wetlands on the property. <br />5. ANALYSIS: <br />A. Conditional Use Permit <br />A CUP is required for a Place of Worship to be located in the Central Residential (CR -3) zoning <br />district. The CUP amendment is required for the building addition. The CUP amendment will <br />supersede all of the existing CUP approvals. <br />The Planning Commission must review the application for a conditional use permit with the <br />standards provided in Section 90-37 of Comprehensive Land Use Regulations. Staff used these <br />standards to review the application and found that the request meets all applicable standards as <br />follows: <br />1. The proposed use is permissible by law. <br />The proposed use is allowed by conditional use permit. <br />2. The proposed use is keeping with the spirit and intent of the ordinance. <br />The proposed use is allowed in the CR -3 zoning district and will keep with the spirit and intent <br />of the ordinance, which is intended to allow a place of worship by a CUP as long as they comply <br />with the regulations. <br />PJ <br />
