Planning Commission Meeting September 26, 2002- page 3 <br />that area and should not be held responsible for work other contractors had done. <br />Belinda Moseng, 6122 152nd Street North, had questions about the connection of the drainage <br />ditch and the reason behind creating the ponds. <br />The Water Resource Engineer explained the laws governing stormwater ponds saying the ponds <br />are necessary to hold and treat water. He also said laws require that the rate of stormwater runoff <br />cannot increase due to new developments, and developments cannot occur if the drainage <br />adversely effects other properties. <br />Randy Moseng, 6122 152nd Street North, asked when the trunk connection would be completed. <br />The Water Resource Engineer said it should be in place before any homes are constructed. <br />The Community Development Director acknowledged there were many complaints regarding <br />backyard swales. <br />John Waller, 14010 Homestead Avenue North, asked what controls there were to ensure that <br />water runs into the appropriate ditch because areas that now drain into Judicial Ditch 2 were never <br />assessed for it. <br />The Water Resource Engineer said that the Watershed District was the ditch authority. <br />Schumann closed the public hearing. <br />Malaski thanked the developers for addressing the Commission's concerns and said she was <br />please with the changes made. <br />Rosenquist asked if the additional berming and trees were based on results of testing done on the <br />noise decibel level. McCully said it was not. <br />Rosenquist asked if the City could supply Bernier an answer about the trees removed from the <br />existing berm. The Community Development Director said the City could check to see if more <br />trees were removed than should have been when the sewer and water project was being done. <br />Schumann suggested a disclosure be put on the sale of the homes to let potential buyers know the <br />adjoining property consisted of industrial uses. <br />Peltier had no comments. <br />Bailly said the development was visually pleasing and that she liked the additional care to be <br />given the trees on the berm. <br />Kleissler said she was impressed by the substantial improvements made to the plan. <br />Schumann concurred with the other members of the Commission and appreciated the staff, Water <br />
