It was also noted that the property is <br />being purchased on contract for deed and the fee owner has not signed the <br />application. <br />One resident felt the rezoning was inappropriate but the SUP should be <br />more lenient so as to allow winter use. <br />Commissioners concurred that this would be considered a spot zoning and <br />access to the lake is difficult. The number of variances required to <br />bring the site into conformance with the CB district is excessive. <br />Motion made by Schumann, seconded by Agness to recommend denial of the <br />Rezoning request for 4444 129th St. North as it constitutes a spot zoning <br />and is not in the health, safety, and welfare interests of the community <br />to rezone this property to commercial use. <br />All aye, motion passed. <br />The City of Hugo is requesting to rezone one acre of a 42.43 acre parcel <br />from SFU to CB adjacent to Highway 61, at the north end of Flay Ave. to <br />allow for the construction of a post office. Administrator Museus stated <br />that there is potential for Flay Avenue to become a through street, but at <br />this time it is proposed to remain a cul-de-sac with no through traffic. <br />Also, there could be ponding or a large wetland on the property. It was <br />noted that the catholic church has expressed an interest in expanding <br />their cemetery in this area, or the property would be used for public <br />purpose. <br />Bernie Brunotte stated that he felt this it would be inappropriate for the <br />post office to be located in a residential area. <br />Commissioner Agness questioned why there was such urgency in moving <br />forward with this request, in 30 to 60 days, considering it has been an <br />ongoing issue for two years. <br />Motion made by Kellison, seconded by Rubenzer to recommend approval of the <br />City's request to subdivide one acre from a 42.43 acre parcel subject to <br />it being served by a cul-de-sac. <br />AYE: Kellison, Rubenzer, Schumann, Peltier <br />NAY: Agness, Waller <br />Motion passed. <br />Motion made by Kellison, seconded by Rubenzer to recommend approval of the <br />rezoning of one acre from SFU to Concentrated Business as described in the <br />survey dated 5-16-96. <br />AYE: Kellison, Rubenzer, Schumann, Peltier <br />NAY: Agness, Waller <br />Motion passed. <br />
