MINUTES OF THE HUGO PLANNING COMMISSION MEETING - MARCH 7. 1995 <br />The special meeting of the Hugo Planning Commission was called to order at <br />7:00PM by Chairman Peltier. <br />PRESENT: Miltz-Miller, Agness, Schumann, Rubenzer, Malaski, Kellison <br />Peltier, Administrator Museus, Attorney Galler, Engineer Dresel, <br />Enqineer Bourassa, Carole LaBelle <br />WOODS OF BALD EAGLE <br />Mr. Jim Merila, representing Grace Development presented their plan for <br />the planned unit development. The proposed project includes 55 single <br />family home sites and 13 attached single family home sites (26 units). <br />The 183 acres of property is in the area from 126th St. north to 134th St. <br />and west of Falcon Ave. and east of Ethan Ave. The addition of the Robert <br />Peterson property bypasses the need to use wetland for the roadway. A <br />twelve acre park is proposed in the northeast portion of the property. <br />The lots range in size from 12,000 sq. ft. to .75 acres. Mr. Merila <br />stated the on site ponding will be capable of holding rainfall of a 100 <br />year storm. Proposed housing will be 300' from the nearest existing <br />residence. <br />The public hearing was opened at 7:30PM. Area residents opposed the <br />proposed subdivision stating that an EAW Petition was requested but not <br />completed, that there was no change from the original plan submitted in <br />1994, traffic safety issues, drainage and potential flooding, developers <br />and City were untrustworthy, diminishes the standard of living in the <br />area. Mr. Jess Rousch protested the oppression imposed by city <br />government. Residents felt it was an attempt at getting approval by a <br />"side door" <br />Attorney Galler clarified that a PUD was in no means circumventing the <br />ordinance and that it was a practical means of development and this <br />request would not be precedent setting. He stated that all real estate is <br />considered unique and evaluated individually. <br />Commissioner Miltz-Miller expressed her concern regarding the potential <br />City liability and maintenance of a small park abutting two city streets. <br />Agness raised concerns with the accuracy of the traffic study formed by <br />the City Engineer which indicated that most of the traffic in the area <br />will move east to west. <br />After a lengthy discussion the following motion was made by Kellison, <br />seconded by Rubenzer to recommend approval of the preliminary plat of the <br />planned unit development of Woods of Bald Eagle subject to the following <br />conditions: <br />1. 127th Street, Europa Avenue and Ethan Avenue, within the plat, be <br />constructed to 38 ft. paved width. This would allow two 12 foot <br />driving lanes for traffic safety, one 8' parking lane for resident <br />convenience, and on 6' pedestrian lane. The pedestrian lane would be <br />on the side of the street where the mail boxes are located to avoid <br />conflicts between the boxes and the parking lane. All other streets <br />within phase a1 of the plat shall be constructed to the City's 32 <br />foot residential standard. <br />2. The developer shall gravel Falcon Ave. from 130th St. to their north <br />property line to allow for emergency vehicle access. It is expected <br />that this road will be further improved as outlots C and E are <br />developed. <br />3. Rice Creek Watershed District approval of the plats drainage plan. <br />
