An Environmental Assessment Worksheet be completed for the entire 183 <br />acres. <br />6. Lots 8, 9, and 10 of Block 3 and all of Block 1, shall not receive <br />building permits or site plan approvals until the City's Municipal <br />Utility Service Area is expanded to include them. This does not <br />guarantee to the developer that such MUSA expansion shall occur. <br />7. Approval of the final utility plan by the City Engineer. <br />B. All sanitary sewer mains and water mains will be extended to the <br />limits of phase I on the plat in accordance with the needs of the <br />city, as determined by the City Engineer. <br />9. Public water and sanitary sewer lines will be sized to allow <br />continuation of service to potential areas of service outside of the <br />plat. The developer shall be reimbursed by the City for any <br />oversizing of these facilities required to serve areas outside of the <br />plat. <br />10. The developer shall provide detailed plans for City approval to <br />reconstruct the drainage ditch leading from the Wilson Tool pond to <br />its outflow from the development. The developer shall be responsible <br />for constructing the improvements as approved by the City. 11. The <br />City shall receive a ponding and flowage easement at a location, and <br />Of sufficient area to allow mitigation for the city's lowering of the <br />elevation of the Wilson Tool pond by two feet. <br />12. The City shall accept the 12.5 acres of parkland dedicated in the <br />plat as fulfillment of the City's recreational and open space <br />requirements. Though the area provided does not meet the total <br />requirements of City ordinance, the City recognizes that the park <br />area proposed will meet the recreational needs of the development, <br />provide greater buildable area for public recreational facilities <br />than is required by ordinance, that the developer is providing a <br />substantial area for storm water ponding not required by the <br />development, that the developer will incur substantial expense in <br />placing gravel on Falcon Avenue, and that 24.9 acres (13.5%) of the <br />development will remain as open space due to wetlands. <br />13. The developer cooperate with the City in the City's cleaning and <br />reprofiling of the drainage ditch extending south from -130th Street <br />along Falcon Avenue to the ditch draining the Wilson Tool Pond. <br />14. At the time of development of outlot C the developer shall provide <br />improved street access to the city park being created as part of this <br />development. This street shall be constructed to the City's standard <br />for a residential street. <br />15. Developer shall provide a bond in an amount sufficient as determined <br />by the city engineer for maintenance of the drainage system for a <br />minimum of three years. <br />16. Covenant and conditions for the lots shall be developed which will be <br />acceptable to the City Council inclusive of a requirement to form a <br />homeowners association that will assess sufficient monies to maintain <br />the drainage system. <br />17. There shall be two accesses only from 130th St. to the 13 attached <br />single family home sites on the south side of 130th St. <br />
