The Planning Commission meeting was called to order at 7:07PM by Chairman <br />Peltier. <br />PRESENT: Miltz-Miller, Agness, Schumann, Peltier, Administrator Museus <br />Carole LaBelle <br />ABSENT: Malaski, Rubenzer <br />Motion made by Kellison, seconded by Agness to approve the minutes of June <br />28, 1995 as amended. <br />All aye, motion passed. <br />Mr. Harley Johnson, Jr., 14196 Fenway Avenue, has requested a SUP to <br />construct a 66' x 48' pole building at the above address. The property is <br />currently zoned RR1, which allows 1,200 sq ft of accessory building. This <br />property is subject to an existing SUP permitting a 48' x 63' structure, <br />which is already located on the site. The Hugo Planning Commission <br />conducted a public hearing on Mr. Johnson's request on June 28, 1995, and <br />recommended approval of the SUP to the City Council. With the assistance <br />of Councilman LaValle, staff has prepared a proposed SUP to address the <br />Council's concerns. <br />Mr. Johnson requested other residents on the road share the cost of dust <br />control. He stated he will not be selling any products besides sod, no <br />rock or shrubs. Mr. Johnson stated he sells approximately 400,000 yards <br />of sod per year. Mr. Johnson also requested he be allowed to work until <br />10:00PM Monday through Saturday. <br />Commissioner Kellison felt a sunset clause would be appropriate to protect <br />against over expansion in a residential area. Limiting the amount of <br />product sold was also recommended. <br />Motion made by Kellison, seconded by Agness to recommend approval of the <br />Special Use Permit for Harley Johnson subject to the following special <br />conditions. <br />1. Property owner may construct and maintain two buildings on the site <br />for the storage and maintenance of equipment and materials related to <br />the permitted business. The buildings may not exceed 3,168 SF each. <br />All equipment and materials maintained on the site related to the <br />business must be stored in the building when not in use. <br />2. Permitted commercial activity on the site shall include only the <br />cultivation, trucking, and sale of sod. <br />3. The hours of product sales shall be limited to 7:00 AM to 7:00 PM, <br />Monday through Saturday, and 9 AM to 7:00 PM on Sundays. <br />4. Trucking of materials and equipment, to and from the site, shall be <br />limited to the hours of 5:00 AM to 10:00 PM, Monday through Saturday. <br />No sod may be hauled onto the site on Sundays. <br />5. The property owners may maintain and operate two trucks up to 80,000 <br />GVW, but not exceed 9 -ton per axle when loaded. <br />6. The haul roads for the business shall be the most direct route from <br />the site along Fenway Avenue and 140th Street to T.H. 61. The <br />property owner shall be responsible for ensuring its agents use these <br />routes. <br />
