The regular meeting was called to order by Chairman Peltier at 7:03PM. <br />PRESENT: Agness, Schumann, Malaski, Kellison, Peltier <br />ABSENT: Rubenzer <br />Motion made by Schumann, seconded by Peltier to approve the minutes of <br />October 25, 1995 as amended. <br />AYE: Agneis, Schumann, Peltier <br />ABSTAIN: Kellison, Malaski <br />Motion made by Schumann, seconded by Agness to approve the minutes of <br />November 2, 1995 as amended. <br />AYE: Agness, Schumann, Peltier <br />ABSTAIN: Kellison. Malaski <br />Dean and Rosalie Stedt, 7416 132nd St. North, have requested a minor <br />subdivision of a 20 acre parcel, they are purchasing on contract for deed <br />from Lorraine St. Sauver, 1812 Birch 8t., White Bear Lake, into one 6.89 <br />acre parcel and one 13.1 acre parcel. The property is currently zoned <br />agriculture. This is an unusual situation since the property being <br />purchased by the Stedts, parcels A and C, are recorded as one parcel with <br />Washington County. Parcel B on the certificate of survey is a 30 acre <br />tract owned by Mrs. St. Sauver, purchased on contract by Stedt's. Tract C <br />being only 6.9 acres does not meet the minimum lot size of the City's <br />agricultural district and it's lot frontage of 176.75 ft. is less than the <br />300 feet required by ordinance. The City has received a copy of the <br />percolation test performed in September of this year for lot C and as yet <br />have not received the permit for the site from Washington County Dept. of <br />Public Health. The City does not have a perc test for Lot A. The boring <br />log from the perc test on site C indicates that the OHW level on the site <br />is 2 to 3 feet below t^^ surface elevation, which indicates that one to <br />two feet of fill will be necessary to construct a home on the site. Since <br />the underlying property title to both parcels rests with Ms. St. Sauver, <br />it would be preferable for the requested subdivision to be altered so that <br />the three parcels on this forty acres all meet the minimum lot size <br />requirements of the City's agricultural district. <br />Several residents opposed the creation of a lot which does not meet the <br />current required road frontage and size requirements. Two other residents <br />felt that a five acre lot was sufficient. <br />Commissioners Agness and Kellison recommended requiring the ten acre <br />minimum, but waiving the parkland dedication fee to aid in paying for <br />additional surveying. Commissioner Schumann suggested leaving the 176 ft. <br />road frontage but increasing the lot size to ten acres. <br />Motion made by Agness, seconded by Kellison to recommend denial of <br />subdivision request of Dean Stedt because it does not meet the City's <br />minimum requirements for the Agricultural district. <br />AYE: Kellison, Agness <br />NAY: Schumann, Malaski, Peltier <br />
