Minutes - 11-15-95 <br />Page 2 <br />Motion failed. <br />Motion made by Schumann, to recommend approval of the request of Dean <br />Stedt, to subdivide 6.9 acres with a variance for 176.76 ft. of road <br />frontage, subdivide to the addition of 3.1 acres to meet the minimum <br />requirement for the agricultural district. <br />Motion fails for lack of a second. <br />Motion made by Schumann, seconded by Peltier, to recommend approval of a <br />subdivision for Dean Stedt to subdivide 10 acres, with a variance to road <br />frontage to 200 ft., and waiver of the parkland dedication fee of $500.00. <br />AYE: Agness, Schumann, Peltier <br />NAY: Kellison, Malaski <br />Motion passed. <br />Commissioner Kellison excused himself from the Planning Commission review <br />of the next agenda item. <br />At the Planning Commission meeting of October 25, 1995, a public hearing <br />was held at the request of Robert McElmury to amend his SUP for operation <br />of Bobber's Boat and Bait, on the north end of Bald Eagle Lake to include <br />ice house rental. The City engineer's review of the safety of <br />establishing a winter access to Bald Eagle Lake from 129th St., a <br />compliance review of the existing special use permit for the site by the <br />City's building official and a detailed site plan from Mr. McElmury was <br />provided to the Commission. <br />The public hearing was opened by Chairman Peltier. Mr. Jim Kellison felt <br />that the engineer's review of the safety issue from 129th Street was <br />inadequately addressed. Mr. Mike Duffy, attorney for Mr. Kellison, stated <br />that after review of the ordinance, felt that issuance of an SUP was not <br />allowed for that zoning district and questioned whether the use could be <br />intensified. Mr. Duffy also stated that the health, safety, and welfare <br />of the adjacent property owners should be taken into consideration' It <br />was noted that several residents complemented Mr. McElmury on the progress <br />he has made in cleaning up the site. <br />Commissioner Malaski would like the SUP issuance reviewed by the city <br />attorney. Noting the date the application was received, and that it must <br />be reviewed by the City Council within 90 days, and no extension for <br />review was granted by the applicant, the following motion was made. <br />Motion made by Agness, seconded by Schumann to recommend denial of the <br />request of Robert McElmury, Bobbers Boat and Bait, for an amended special <br />use permit to include rental of ice fishing houses on Bald Eagle Lake for <br />the following reasons. <br />1. Non compliance with the current Special Use Permit. <br />2. Poor location for additional traffic. <br />All aye, motion passed. <br />
