Minutes - May 25, 1994 Page 3 A public hearing has been scheduled to consider the request of Richard Carron and Darrel Hanson to conduct mining operations on the northwest 1/4 of the southwest 1/4 of Section 23, T31N, R21W, and the east 1/2 of the southeast 1/4 of Section 23, T31N, R21W. This permit has been the subject of litigation between the City of Hugo, the applicants, and the citizen's group known as Hugo 2000. On May 2, 1994, the Hugo City Council entered into a settlement agreement with the other parties in the litigation to satisfy, to the best extent possible, the claims and competing interests of the groups involved. Staff recommends approval of the Special Use Permit, subject to the conditions and restrictive covenants of the settlement agreement filed with the Tenth Judicial District Court, as court file number C7-92-4225. Jonathan Miesen, representing Hugo 2000 stated that River City Asphalt should be required to obtain a mining permit before any further mining would be done and also file a reclamation plan with the City prior to the SUP being approved. Administrator Museus has recommended that the SUP and the Mining Permit be dealt with individually and because of the pending litigation. Motion made by Agness, seconded by Schumann to recommend approval of the request of River City Asphalt for a Special Use Permit to mine the property described above subject to the terms and conditions of the Settlement Agreement known as Tenth Judicial Court file #C7-92-4225. All aye, motion passed. Commissioner Agness encouraged the applicant to file a reclamation plan and obtain a mining permit as soon as possible. David Schumann from the Environmental Committee, Sandy Malaski, from the Image Committee, and Jim Kellison from the Economic Development Committee reviewed the work done by each of their groups for revision of the City's comprehensive plan. Commissioner Rubenzer arrived. CONSULTANT INTERVIEWS - COMPREHENSIVE PLAN The Planning Commission interviewed David Licht of Northwest Associated Consultants, and Mr. Ed Elliot of Loucks and Associates, to determine their ability to assist with the preparation of the City's Comprehensive Plan. Concerns were expressed by Kellison and Agness regarding the large difference between the cost associated with the two proposals and the question if the two proposals were similar enough in scope for the Planning Commission to make a decision.
