Minutes - May 25, 1994 <br />Page 3 <br />A public hearing has been scheduled to consider the request of Richard <br />Carron and Darrel Hanson to conduct mining operations on the northwest 1/4 <br />of the southwest 1/4 of Section 23, T31N, R21W, and the east 1/2 of the <br />southeast 1/4 of Section 23, T31N, R21W. This permit has been the subject <br />of litigation between the City of Hugo, the applicants, and the citizen's <br />group known as Hugo 2000. On May 2, 1994, the Hugo City Council entered <br />into a settlement agreement with the other parties in the litigation to <br />satisfy, to the best extent possible, the claims and competing interests <br />of the groups involved. Staff recommends approval of the Special Use <br />Permit, subject to the conditions and restrictive covenants of the <br />settlement agreement filed with the Tenth Judicial District Court, as <br />court file number C7-92-4225. <br />Jonathan Miesen, representing Hugo 2000 stated that River City Asphalt <br />should be required to obtain a mining permit before any further mining <br />would be done and also file a reclamation plan with the City prior to the <br />SUP being approved. <br />Administrator Museus has recommended that the SUP and the Mining Permit be <br />dealt with individually and because of the pending litigation. <br />Motion made by Agness, seconded by Schumann to recommend approval of the <br />request of River City Asphalt for a Special Use Permit to mine the <br />property described above subject to the terms and conditions of the <br />Settlement Agreement known as Tenth Judicial Court file #C7-92-4225. <br />All aye, motion passed. <br />Commissioner Agness encouraged the applicant to file a reclamation plan <br />and obtain a mining permit as soon as possible. <br />David Schumann from the Environmental Committee, Sandy Malaski, from the <br />Image Committee, and Jim Kellison from the Economic Development Committee <br />reviewed the work done by each of their groups for revision of the City's <br />comprehensive plan. <br />Commissioner Rubenzer arrived. <br />CONSULTANT INTERVIEWS - COMPREHENSIVE PLAN <br />The Planning Commission interviewed David Licht of Northwest Associated <br />Consultants, and Mr. Ed Elliot of Loucks and Associates, to determine <br />their ability to assist with the preparation of the City's Comprehensive <br />Plan. <br />Concerns were expressed by Kellison and Agness regarding the large <br />difference between the cost associated with the two proposals and the <br />question if the two proposals were similar enough in scope for the <br />Planning Commission to make a decision. <br />
