vL**INNING GOMMlSS%ON MINUTES - JANUARY 27. 199::!! <br />The regular meeting of the Hugo Planning Commission was called to order by <br />Chairperson Mezzano at 7:03 p.m. <br />PRESENT: Mezzano, Agness, Davis, Rubenzer, Olson, Administrator Museus, <br />Bonnie Weber <br />ABSENT: Peltier, Oswald <br />Motion made by Olson, seconded by Rubenzer to approve the minutes of <br />December 18, 1992. <br />All aye, motion passed. <br />Josepm and Pam Monno have applied for a special use permit to keep horses <br />on their property at 5773 Egg Lake Road which is zoned RR1. Chapter <br />320-4, subd E (3), relating to property zone RR1 states "the keeping of <br />non-domestic animals, other than hogs or goats, shall be permitted special <br />uses on lots of 5 acres or more, within the following limitations: one <br />horse, cow or sheep permitted on 5 acres and one additional animal for <br />each acre over five." The property in question is 5.3 acres in size, this <br />allows the keeping of one horse as a special use under the City's zoning <br />ordinance. The Monno's request to maintain two horses on the site is <br />based on evidence that more than one horse has been maintained on this <br />property prior to and continuously since February 6, 1975, the date of <br />adoption of the City's zoning ordinance, and therefore they are eligible <br />for the "grandfathering" provisions of state law. <br />Chairman Mezzano opened the public hearing. <br />Mr. Monno stated that two horses had been at the property since 1970 and <br />until he received a letter dated September 30, 1992 from the City of Hugo <br />he as not aware that he was in violation of the City ordinance. He was <br />wondering if the "grandfathering" provision would apply. <br />Discussion followed on the "grandfathering" provision as to what it means <br />and how it works. Administrator Museus explained that "grandfathering" <br />was quite common and has been used in the past. "Grandfathering", <br />however, is only an argument for a special use permit and not an action in <br />and of itself. <br />Agness asked if such a variance as requested could have a time limit on it <br />with and end date. <br />
