Planning Commission Minutes - July 22, 1992 <br />Page 2 <br />Administrator Museus stated that a public hearing has been scheduled <br />regarding the existing Special Use Permit for Zap Games, Inc. to conduct <br />paint ball games at 7000 132nd St. in Hugo, Minnesota, following the <br />complaint by Stanford Krueger that the game site was in a state of <br />disrepair and that generally the game operators were not fulfilling the <br />requirements placed on them by the Special Use Permit. Zap Games, Inc.'s <br />SUP provides for an annual review at the discretion of the City Council. <br />Zap Games, Inc. has been changed to Midwest Paint Ball, Inc. as registered <br />with the Secretary of State. <br />Mr. Krueger alleged numerous permit violations by the company. Mr. <br />Krueger presented a petition signed by residents supporting the revocation <br />of the SUP for Zap Games, Inc. <br />Mr. Tony Caron, owner of Zap Games stated that the site may have been <br />somewhat neglected, however when the issues were brought to his attention <br />the problems were corrected. Mr. Caron stated that during their busiest <br />season there could be approximately 200 people through the site on a <br />weekend. The building currently on site is the equivalent of a seasonal, <br />roadside fruit stand, with no foundation and not permanent. The company's <br />certificate of insurance is currently on file in the clerk's office. <br />Commissioners concurred that the violations listed were not of monumental <br />proportion and could be corrected. <br />Motion made by Mezzano, seconded by Davis to recommend continuation of the <br />Special Use Permit for Midwest Paint Ball, Inc., dba Zap Games subject to <br />the following changes: <br />1. Permit issued to the name as recorded with the Secretary of State, <br />"Midwest Paint Ball, Inc. dba Zap Games". <br />2. The operating season be from April 1 through October 31 from 8:00AM to <br />6:00PM. <br />3. All trash must be removed from the site daily. <br />4. Remove all items at the end of the season (picnic tables, building, <br />etc.) <br />5. The sign requirement be strictly enforced with more permanent signs <br />being installed on the perimeter of the game site, at aproximately 50' <br />intervals. <br />6. The access driveway to the site be more defined to avoid a trespassing <br />situation on the neighbors driveway. <br />Members voting AYE: Mzzano, Agness, Davis, Olson, Peltier <br />Members voting NAY: Oswald <br />Motion carried. <br />City Administrator Museus has begun to establish a program for the <br />Planning commission to review amendments to the City's comprehensive <br />plan. A work session has been tentatively scheduled for the Planning <br />
