Planning Commission minutes of 10124190 <br />Page 2 <br />St. The site is zoned RR1 and SFE and abutts on Egg Lake. The applicants <br />have made the necessary request for permits from the Rice Creek: Watershed <br />District, and are having percolation tests done for parcel P. There is <br />currently a home and out -buildings located on parcel A. The legal <br />description of the property is somewhat vague with regard to its north <br />property line as there is some question as to the precise location of said <br />line. Mr. Molitor is going through the necessary legal process for <br />property registration to clear up this matter. The applicant is <br />requesting Planning Commission review of this request with the <br />understanding that this matter will not go before the City Council until <br />the necessary RCWD permits and percolation tests have been submitted for <br />review. Mr. Molitor was present, and stated that the problem with the <br />property line was with the meander line on Egg Lake, not the north <br />property line. <br />Chairman Senkler opened the meeting for public comment, and there were no <br />oral or written comments. <br />Mezzano made motion, Thoreson seconded, to recommend approval of the <br />request of Mr. Henry Molitor for a minor subdivision, and waiver of the <br />formal platting requirements, to subdivide a 10 acre tract of land into <br />two lots of approximately five gross acres each on the property described <br />as the South 10 acres of Gov't Lot 3 in Section 20, T31N, R21W, being a <br />strip of land from off the south part of said Lot 3 of sufficient width <br />making the north line thereof parallel with the south line of said Lot <br />so as to contain 10 acres of land. Approval is subject to the following <br />special conditions: <br />1. The final survey must be submitted to the City Council within 90 days <br />of preliminary survey acceptance or Planning Commission approval shall <br />be null and void. <br />2. All conditions of plat approval must be met prior to the stamping of <br />any deeds for recording by the city clerk unless otherwise permitted <br />by Council action. <br />3. The property lines on site must be identified by the applicants to <br />assure proper setbacks when buildings are to be constructed if <br />required by the building inspector. <br />4. Proposed driveways or drainage areas within the development must <br />include installation of a minimum 15" diameter corrugated metal <br />culvert in a manner acceptable to the city. <br />5. No building permits shall be issued until the survey has been approved <br />and recorded with Washington County. <br />6. Securing the required permits from the watershed district is required <br />prior to final survey approval. <br />7. Percolation tests for Parcel "L" must be submitted to the city prior <br />to final survey approval. <br />B. Dedication of required parkland or payment of fee in lieu of parkland <br />dedication shall be made to the city prior to final plat approval. <br />9. No improvements, landscaping, or grading shall be permitted in the <br />defined drainage areas without the express written authorization of <br />the City and the approved watershed districts. <br />10. All property owners shall be responsible for maintenance of drainage <br />areas within easements on their property. <br />
