7. All fees relating to this subdivision shall be paid by the applicant <br />including the cost of recording documents with Washington County. <br />8. Percolation tests for each buildable site must be submitted to the <br />city and approved prior to final survey or plat approval' <br />9. Payment of fee in lieu of parkland dedication shall be made to the <br />city prior to final plat approval. <br />10. No improvements, landscaping, or grading shall be permitted in the <br />defined drainage areas without the express written authorization of <br />the city and the approved watershed districts. <br />I.I. The property owner shall be responsible for maintenance of drainage <br />areas within easements on their property. <br />12. Developer shall comply with all requirements and restrictions <br />applicable to identified wetlands and dedicate easements where <br />required. <br />13. No significant deviations from the approved preliminary survey shall <br />be permitted unless reviewed by the planning commission prior to <br />council approval. <br />14. The developer shall permit access to the referenced site for periodic <br />inspections to assure conformance with this special use permit. <br />15. Legal descriptions of all parcels to be subdivided shall be included. <br />All aye, motion passed. <br />Plan Amendment <br />Recently it was brought to the city's attention that the Municipal Urban <br />Service Area identified on the city's maps is not consistent with that <br />recognized by the Metropolitan Council. There were apparently two maps <br />prepared, one showing an area proposed by the city and one showing the <br />sewered area approved by the Metropolitan Council. The map sent to the <br />city was incorrect and this resulted in some errors in previously approved <br />plats. The plat of Bald Eagle Estates approved by the city, Metro Council <br />and subsequently permitted by the Metro Waste Control Commission is only <br />partially within the city's Municipal Urban Service Area. This <br />development somehow slipped through the cracks in the review process by <br />four different agencies as a result of the confusion regarding the <br />approved M.U.8.A. The Metropolitan Council Planning Staff has recommend <br />that we apply for an expansion of our M.U.S.A. to include the sixteen <br />acres in question which is located north of 126th St. and west of Highway <br />61. The plat in question is provided with sanitary sewer, street, curb <br />and gutter, and homes have been built in this subdivision. The procedure <br />we are following is that recommended by Met Council planning staff in an <br />effort to clean up this error and clarify our MUSA. <br />Stuart Schmeling, administrative intern for the City of Hugo reviewed this <br />issue with the planning commission. He informed the commission that the <br />Metropolitan Council required the request for expansion of the MUSA be <br />reviewed by the planning commission. <br />Motion made by Senkler, seconded by Henry to recommend approval of the 16 <br />acre addition to the Metro Urban Service Area within the City of Hugo to <br />include the area already served by sanitary sewer service. <br />All aye, motion passed <br />
