P.C. Minutes - October 26, 1988 <br />, pAe 8 <br />Mr. Senkler requested Mr. Huber review the application with the planning <br />commission. Mr. Huber stated that Vern and Marie Peloquin have made <br />application to the City of Hugo for a minor subdivision for the purpose of <br />creating a parcel of land adjacent to Peloquin Industrial Park in an <br />Industrial zone. The property in question is generally described as a 1.7 <br />acre tract of land located in that part of the west 1/2 of the southwest <br />1/4 of Section 17, T31N, R21W, Hugo, Minnesota. The Peloquin Industrial <br />Park has a confusing history and the city staff has spent considerable <br />time trying to recreate the piece meal subdivision of this industrial <br />area. Dating back to 1974 Mr. Vern Peloquin has subdivided various tracts <br />of an industrial zoned area of land on a lot by lot basis which has <br />resulted in the creation of what is now known as the Peloquin Industrial <br />Park. All of the minor subdivisions have been done by Mr. Peloquin with <br />the exception of the plat of Husnik's Industrial Park which consisted of <br />five lots that were subdivided by formal plat. The park in question has <br />gravel roads and no municipal sewer or water. Because of the manner in <br />which this land was subdivided, a formal plat Was not created, therefore, <br />the requirements of the formal platting process were not adhered to. All <br />sites under 5 acres in size were not reviewed by the Rice Creek Watershed <br />District and therefore much of this development occurred without their <br />review. In 1981 the city received a letter from the watershed district <br />indicating that any further subdivision in the Peloquin Industrial Park, <br />regardless of the lot size, must be submitted to the district because of <br />the impact on the adjacent Clearwater Creek. In reviewing Mr. Peloquin's <br />initial request the staff strongly recommended that this subdivision be <br />done by formal plat including all acreage owned by Mr. Peloquin within the <br />industrial area that currently is not platted. Although Mr. Peloquin <br />notes in his September 23, 1988, letter that there is no more land <br />available, Mr. Peloquin does own several tracts of land identified on the <br />composite map that have not been subdivided to date. Mr. Peloquin has <br />chosen however, to again subdivide this area by minor subdivision and <br />continue the piece meal development approach in this area. It is <br />extremely difficult to evaluate this parcel as it has developed without <br />the typical plat amenities because of the minor subdivision approach. If <br />the planning commission recommends approval of this minor subdivision and <br />waiver of the formal platting requirements we would recommend that said <br />approval be subject to special conditions. <br />Mr. Peloquin stated that the proposed subdivision would be used by <br />American Structural Steel as storage space for their trucks. He also <br />stated that Rice Creek Watershed is requiring a 50' easement on the west <br />portion of the property in the industrial park and he has refused to grant <br />them the easement. <br />Chairman Senkler requested public comments. Mr. Joe Marier was concerned <br />that this subdivision would deny him access to his property on the east <br />and no provisions for easements or roadways have been addressed. <br />Commissioners Barnes and Senkler were concerned that there is no overall <br />picture of the drainage plan or if there is a specific drainage plan for <br />the industrial park, what permits if any have been issued. Mr. Senkler- <br />inquired <br />enklerinquired whether it was appropriate to require a formal plat for one lot. <br />Administrator Huber stated they could require a formal plat for one lot <br />and deny waiver of the formal platting process. It was noted that former <br />
