Minutes - October <br />28, 1988 <br />9 <br />officials had apparently <br />informed <br />Mr. Peloquin that <br />no further subdivision <br />would be allowed <br />without a formal <br />plat, however, <br />there are no documents to <br />that effect. Mr. <br />Senkler felt this <br />subdivision <br />could have an effect on <br />adjacent property <br />and would like <br />to see the best <br />possible development of <br />the remaining area. <br />Commissioner <br />Barnes stated <br />the they should address <br />the drainage problems <br />which may already <br />exist and <br />there is no way to do <br />this on one small <br />lot. <br />Motion made by Senkler, seconded by Barnes to recommend to deny the waiver <br />of the formal platting procedure of the subdivision request of Vern <br />Peloquin and request that Rice Creek Watershed District review the entire <br />area owned by Mr. Peloquin in the industrial zone not just the proposed <br />lot. <br />Members voting AYE: Jesinski, Barnes, Thoreson, Senkler <br />Members voting NAY: Sullivan, Henry <br />Motion passed. <br />Chairman Senkler requested Administrator Huber reviw the application with <br />the planning commission. Mr. Huber stated Jennie and Melvin Vietor have <br />made application to the City of Hugo for the subdivision of a 19.84 acre <br />tract of land into residential parcels in an agricultural zoning <br />district. The property in question is located on the east side of Jeffrey <br />Ave. in part of the east 1/2 of the southeast 1/4 of Section 11, T31N, <br />R21W, Washington County, Minnesota. The tract of land located south the <br />parcel B is owned by another party and the tract of land located north of <br />parcel A is owned by Mrs. Vietor. The applicant has requested waiver of <br />the square footage requirement for Parcel B and lot width for Parcel B <br />because the easement north of Parcel A, and building locations, restrict <br />the size of the site. Apparently the access easement north of parcel A is <br />a fenced area and it might create some difficulty if the property line was <br />moved from the proposed location. If the planning commission recommends <br />approval of this subdivision to the city council we would suggest that <br />said recommendation be subject to special conditions. <br />There was no one from the public to comment on the subdivision request. <br />Mr. Melvin Vietor stated the property is to be subdivided and sold to pay <br />for nursing home care for Jennie Vietor. It was acknowledged that the <br />300' lot width at the setback line could be maintained on parcel B. <br />Motion made by Sullivan, seconded by Jesinski to recommend approval of the <br />subdivision for Melvin and Jennie Vietor subject to the following special <br />conditions: <br />1. The preliminary survey be submitted to the city council within 90 days <br />of the commission's recommendation and the revised survey incorporate <br />the recommendations of the staff, Rice Creek Watershed District, and <br />other governmental agencies. <br />2. The preliminary survey will not be submitted to the council until all <br />legal, engineering, and staff recommendations have been incorporated <br />into the survey. <br />3. All fees relating to the subdivision shall be paid by the applicant <br />including the cost of recording documents with Washington County. <br />4. Developer pay fee in lieu of parkland dedication at the time of final <br />survey approval., <br />
