A matter before the Commission shall be presented <br />in summary by a member of the Commission or staff person de- <br />signated by the Chairman and any party having an interest <br />shall have the privilege of the floor. <br />Section 4. Audio tapes of the Planning Commission meetings <br />shall be retained for a period of two years. <br />Section 5. No request requiring a public hearing may be heard <br />by the Commission prior to holding the required hearing. <br />ARTICLE IX AMENDMENTS <br />These procedures and policies may be amended by a majority <br />vote of the entire membership of the.Cuw-mission. <br />Rezoning request - Forest Lake State Bank <br />The public hearing was opened at 7:06PM by Chairman Rudisill. City Adminis- <br />trator..Huber gave the following presentation.. <br />The public hearing has held February 25, 1987, to consider the request <br />of the Forest Lake State Bank to rezone an 8.9 acre tract of land from <br />Agricultural to Retail Business. The propety in question is located near <br />the northeast corner of Highway 61 and 170th St. and generally described <br />as follows; <br />A part t,f the SE J of Section 5, Township 31N, Range 21W. <br />The property contains approximately 308 feet of frontage on U.S. Highway <br />61 and approximately 571' of frontage on 170th St. No. The property abutts <br />agricultural zones on the east, west, and south. The zoning districts to <br />the north are agricultural and retail business. Mr. Jim Harding representing <br />the Forest Lake State Bank has indicated that there is no specific proposal <br />for development on this parcel of land and that the bank is taking a <br />postition that the highest and best use for this property would be retail <br />business. The uses permitted in an RB District consist of offices, bus- <br />iness school, medical uses, photographer studios, retail florists, beauty <br />and barber shops, libraries, urban agriculture, and retail shopping. Special <br />uses permitted in an RB zone can be found in the zoning ordinance 320-4, Sub.d J-3. <br />The proposed rezoning to RB appears to be somewhat consistent with other dev- <br />elopments and districts to the north of the property in question. The uses <br />currently permitted on this site can be found in 320-4, Subd. C 1,2,3, of <br />the zoning regulations. Hearing notices were sent to adjoining property <br />owners and the legal notice published in the White Bear Press. <br />Mr. Jerry Hammer, 6316 170th St. and Greg Sarvela adjoining property owners <br />stated their objections to the rezoning, which included a concern for the <br />water table, increased traffic, and generally felt that additional business <br />property was not needed in a primarily residential area. Mr. M. Hathway <br />property owner on 170th St. was in favor of the rezoning stating that High- <br />way 61 is the natural area for commercial growth. <br />The public hearing was closed at 7:27PM. <br />Commissioners Blanchard, Jesinaki, and Schreifels pointed out that most bus- <br />
