P.C. Minutes page 6 - May 27, 1987 <br />10. Impulse noise levels shall at no time exceed the levels to be drawn up by <br />the Pollution Control Agency. The City of Hugo keeps the option of setting <br />more restrictive levels, if needed, because of the general quiet nature of <br />the City. <br />11. The owners shall have sixty (60) days from the date they are notified that <br />they exceed these standards to prepare and submit to the City Council and <br />Planning Commission, detailed plans for abatement of noise so that the <br />operation will be brought within the required standards. Once the plans <br />are approved by the City Counci v <br />, the owners will have six (6) months to <br />ca -p fete construction in accordance with the abatement plans so approved. <br />12. At no time shall there be a change in the physical operation of the club <br />without notification to the City, and at no time shall the current size <br />of the physical operation of the club be increased. <br />13. The 200 yard range to be discontinued at its current location. The 200 <br />range may be reinstated only after approval by the City. <br />14. Should the City Council determine that any of the conditions of the Special <br />Use Permit have been violated, and that said violation has not been cor- <br />rected within thirty (30) days of notification of the property owner of said <br />violation, the City Council shall schedule a public hearing, with notice to <br />the owners, to consider the violation or violations, and thereafter may <br />suspend, modify, or revoke the Special Use Permit, giving reason for the <br />action taken. <br />15. The facility may open to the public only on Saturdays and Sundays. At all <br />other times, use of the facility shall be limited to members and their <br />immediate families; and bonafide guests, which shall not exceed three (3) <br />guests per member present. <br />16. The club shall file, with the City, its scheduled operations as it relates <br />to all Sunday activities, and to any regularly scheduled events within the <br />facility, in March of each year. The City shall be notified, at least <br />ten (10) days in advance of any Sunday during.which extended hours will <br />be used. <br />17. The owners shall hold the City of Hugo harmless from any loss, expense, <br />damage, incuding reasonable attorney's fees, that may be incurred as a <br />result of granting the within Special Use Permit. <br />18. The owners shall provide the City with a performance bond, in the amount <br />of $5,000.00, to insure maintenance of the physical facilities in the <br />condition herein outlined. <br />19. The Special Use Permit shall be reviewed on an annual basis. <br />20. The existing facilities are as shown on Exhibit A, and shall not be changed <br />as herein provided. <br />21. Muzzleloaders will not be permitted to use the facility. <br />22. The BESA will absorb the cost to calcium chloride Goodview Avenue approxi - <br />irately 8/10's mile. <br />23. BESA will provide the names of three people responsible for maintaining <br />the rules of the club so that they can be contacted in case of any rule <br />infraction. The club will provide a copy of their shooting schedule to <br />any neighbor requesting a copy. A copy to be provided to City Hall as well. <br />24. Two days, in both July and August, will be designated as DCM shoot days. <br />(Director of Civilian Marksmanship) _ <br />
