There was no public to comment. <br />The Weber public hearing was adjourned and the regular meeting called to order at <br />8:12PM. <br />William Rust - SUP - Motion made by Rudisill, seconded by Atkinson to recommend <br />approval of the Special Use Permit for William Rust, 12280 Goodview to operate <br />a commercial nursery at his residence with the following conditions; <br />1. Hours of operation should be from 7:OOAM - S:OOPM monday through Saturday. <br />2. Screening to be planted for neighbors to the south. <br />3. Delivery of rock should be only after a freeze in late fall. <br />4. No vehicles larger than a bobcat. <br />5. Calcium chloride to be applied twice a year. <br />6. Only three employees on the premises. <br />Rudisill amend motion to eliminate number 5, Atkinson seconded. <br />Rudisill amends motion to increase employees to 6, Atkinson seconded. <br />6. Special Use Permit should be on an annual renewal basis. <br />AYE: Fashingbauer, Rudisill, Olson. NAY: Atkinson. Motion carried. <br />Zap Games - The general concensus of the Commission was that this activity <br />would create too much traffic, attract undesireable participants and the possibility <br />of injuries was too great. Mr. Atkinson did not feel there was any real reason <br />to deny such a permit and the property owners should be allowed to use their property <br />as they choose. The applicants have stated they currently have full insurance <br />coverage and liquor is strictly prohibited, and that some car pooling is already <br />being done. Atkinson points out that the activity has been going on for over a year <br />and there have been no comments by residents. <br />Atkinson made motion, seconded by Rudisill to recommend approval of two Special <br />Use Permitsto Zap Games Inc. to operate at two locations, 7040 132nd St. and <br />6063 145th St. with the following conditions; <br />1. All participants will be required to wear eye and ear protection. <br />2. Number of participants on any field at any given time be limited to 30. <br />3. No alcoholic beverages or drugs and anyone intoxicated will not be allowed to <br />participate. <br />4. Off street parking shall be provided for all participants. <br />5. Satellite or equal typeof facilities be provided at both sites. <br />6. $300,000 liability insurance shall be kept in force at all times games are <br />operating. <br />7. No one under 18 years of age will be allowed to participate. <br />8. No Trespassing signs shall be installed on the perimiters of the playing areas <br />and operators shall instruct participants to confine their games to the <br />approved areas. Failing this, the City reserves the right to require fencing <br />at some future date if damage to surrounding property becomes a problem. <br />9. No game shall be allowed when the temperature is 40° or lower. <br />10. Applicants draft a hold harmless agreement in favor of the City of Hugo to <br />indemnify and protect the City against lawsuit arising out of these activities. <br />AYE: Atkinson.
