The Planning Commission questioned <br />the necessity of the Special Use Permit, because this type of operation appears <br />to be allowed in the industrial zone. Stoevenel stated that the original plat <br />of this property consisted of 4} acres, but only a portion of that would be sold <br />for the new business (1.32 acres). Evidently, Ken Tschida holds an unrecorded <br />transaction tying up the parcel until July 23, 1981. Peloquin felt that the city <br />should be looking at a Minor Subdivision for the sale of the 1.32 acres. The <br />Planning Commission did not feel that they could act on an application for a Special <br />Use Permit at this time, because the property has not been clearly defined. <br />Motion made by Peloquin, seconded by Greger, that because of the time deadline <br />(closing of June 1, 1981), the entire matter be handled by the City Council after <br />consultation by the realtor with the City Attorney. <br />All aye. Motion Carried. <br />PETE 14ADEAU AND DON OLSON - CONSTRUCTION OF HOME <br />Mr. Olson is interested in purchasing the lot located at Highway 61 and 150th Street <br />(south east corner). This property lies in the SFU zone. Mr. Nadeau presented <br />the Planning Commission with a legal description dated 1947 with a lot size of <br />40 x 150. Peloquin reviewed the Pine Tree Addition plat and it was determined that <br />the lot is actually 40 x 129 because of the upgrading of Highway 61 in the 1950's. <br />Mr. Nadeau felt that this should be a buildable lot because the owner has been <br />paying assessments on the lot for a number of years. ',As the lot sits, it would <br />be impossible to meet the setback requirements for interior lot lines. The <br />Planning Commission stated that they would not approve variances for the con- <br />struction o0house on this lot. <br />Motion made by Lorch, seconded by Hanson, that Mr. Olson appear, before the City <br />Council at.their meeting of May 18, 1981, and at that time, with the help of the <br />City Attorney, determine if there is any way this can be a buildable lot, and if <br />the city has any legal responsibility to make into a buildable lot. <br />All aye. Motion Carried. <br />The Planning Commission did not discuss. the change in State Statute regarding division <br />of large lots. <br />Motion made by Hanson, seconded by Lorch, to adjourn at 10:45 PM. <br />All aye.
