March 149 1984 <br />Dear Planning Commission <br />For those of you in the audience who might not be aware of it, an <br />informational meeting was held at the White Bear Lake Rod and Gun Club on <br />March 3, 1984. Present were many members of the Hugo Planning Commission <br />and Hugo City Council, also in attendance were the officers of the H.E.L.P. <br />organization. <br />The gentlemen seated at the gun club's speaker table were Mr. Maurice <br />Neault, President, Mr. Jerry Perron, Consultant, i,r. Craig 0. Linnell, <br />Ph.D. and Acoustical Consultant, Mr. Dave Kelso, 'idnnesota Pollution <br />Control Agency Acoustical Department, and k1r. Robert Johnson, Attorney. <br />In the following letter attachments, I would like to bring <br />forth information, laws, and regulations th:3t may be applicable to this <br />situation. <br />First, Mr. Linnell (Ph.D.) at several points on :larch 3, 1984, stated <br />that the 40 dba requirement was too low, and on one occasion, stated that <br />no where in the country could he find a sound requirement anywhere close <br />to the 40 dba as stated in the special use permit. I suggest Dr. Linnell <br />didn't look too far. I submit as attach-nent #1 a copy of the noise ordinance <br />for Washington County State of !•iinnesota, which on nage 105, section 724.02 <br />states, that under certain conditions a dba, reading of 40 decibels must be <br />met. <br />Mr. Linnell, Ph.D., stated on ,'-.arch 3, 1984, that he thought 5 dba <br />should be added in comparing impulsive noise to other types of noise. <br />I stated it was 6 dba, but now find in U.S. Code of Federal Regulations <br />Book 24, page 229, paragraph 3, attachment #2... <br />113. Loud Impulsive Sounds. When loud impulsive sounds such as <br />sonic booms or explosions are anticipated contributors to the <br />noise environment at a site, the contribution to day -night <br />average sound level produced by the loud impulsive sounds shall <br />have 8 decibels added to it in assessi p the acceptabilily of a <br />site." -- <br />Therefore, using decibel levels attained on Saturday, March 3, 1984, <br />which were 42 dba to 53 dba we now shall add 8 decibels as per Federal <br />regulations and we have readings of 50 dba to 61 dba, which should <br />
