Hugo Planning Commission <br />September 28, 1977 <br />Page 2 of 5 <br />Richard Schuh — Amended Mining Permit <br />Mr. Schuh presented a revised map of the area to be mined. Ehret <br />stated that the map indicated the contour lines showed were right <br />from the property line. The set back should be 501. He stated <br />that a corrected copy of the map showing 50' set back should be on <br />file. Schwab said that if a written consent from the property owners <br />to the south and west is filed with the clerk stating that there <br />was no objection, that this would be acceptable also. He also <br />stated that the mining has to be 50' from the street. Mr. Schwab <br />did not feel that a Mining Permit automatically allowed for a <br />blacktop plant. <br />McAllister made motion, -to table the Mr. Schuh request until the <br />next regular meeting, October 12, 1977, and that the secretary be <br />directed to contact the City Attorney, asking him to give his inter— <br />pretation as to whether a blacktop plant is automatically covered <br />in a Mining Permit as defined in Chapter 170 of the Hugo Code. <br />There was no second to this motion. Motion failed. <br />Motion made by Peloquin, seconded by Peltier, that the Planning <br />Commission recommend approval of the request by Mr. Schuh to <br />allow additional mining, subjectto the following: <br />(SEE ATTACHED RECOMMENDATION) <br />VOTING FOR: Peloquin, Peltier, and Ehret <br />VOTING NO: McAllister <br />ABSTAINED: Gillen <br />Motion carried. <br />Motion made by Peloquin, seconded by Peltier, to recommend to amend <br />the Special Use Permit for Lavina Duraine, to coincide with the <br />amended Mining Permit for Richard Schuh, subject to the following: <br />1. Extend Special Use Permit until June 1, 1978. <br />2. Post bond in the amount of $5,000.00 <br />3. The bituminous hot mix plant should be allowed. <br />4. All existing trees and natural vegetation bordering the pit <br />area shall be left undisturbed. <br />5. All top soil in the pit area shall be stockpiled, and at <br />the time the operation is completed, the top soil shall be <br />replaced and seeded to grass cover. <br />6. Sewer facilities shall be of the portable, chemical holding <br />tank type. <br />
