GRAVEL PIT AND STOClPII,E OPERATION <br />Pursuant to the provisions of Ordinance 107 of the City of Hugo, <br />Minnesota, entitled "An Ordinance Establishing Mining Regulations to Provide <br />For Orderly, Economic, and Safe Removal of Sand, Gravel, Rock, Soil, and Other <br />Natural Deposits and to Promote the Public Health, Safety, and Morals, and <br />General Welfare in the City of Hugo, Washington County, Minnesota", a Mining <br />Permit is issued to: <br />RICHARD F. SCHUH <br />1087 County Road H2 <br />White Bear bake, Minnesota 55110 <br />For a period to expire on June 30. 1979, unless sooner terminated pursuant to <br />the provisions of said Ordinance, and subject to the following conditions: <br />1. All applicable provisions of the City of Hugo Ordinance governing mining <br />shall be complied with. <br />2. The scope of the Mining Permit shall be limited to the terms included in <br />the "Application for Mining Permit" dated October 27, 19759 a copy of which <br />is attached hereto and incorporated herein by reference, it being understood <br />that the permit is limited to stockpiling and hauling away the existing <br />stockpile of granular material and asphalt mix and restoration of the area, <br />and that no material may be hauled to the site except for approximately <br />4500 tons of 5/8" crushed rook to blend with the existing material on the <br />property, and the excavation, crashing, stockpiling and hauling away of <br />material shown on the contour map. <br />3. No top soil or overburden shall be removed from the site. <br />4. Haul roads shall be Irish Avenue South to County Road 8A, and 152nd Street <br />east to Jeffrey Road, only. <br />5. Dust control on all city streets shall be by the use of oil (crankcase oil), <br />or calcium chloride, as directed by the City Engineer. <br />6. The inspection fee shall be deposited in the awrunt of =500.00, and engineering <br />and legal inspection shall be done as needed. <br />7. The contractor shall provide and maintain both a x109000.00 bond and a #25,000.00 <br />irrevocable letter of credit for the maintenance and/or reconstruction of the <br />haul roads, and to insure compliance of all conditions of the permit. <br />8. Recommendations fo the Engineer of the City of Hugo, as they may be made <br />from time to time, shall be made a part of this permit. <br />9. Inspection to insure compliance with this permit will be done by the Engineer <br />of the City of Hugo, and he may request that the assistance of such other <br />persons or organizations as he my deem necessary. <br />10. Any violation of the terms or conditions of this permit shall be grounds for <br />immediate termination in accordance with the City Ordinance. <br />
