City Council meeting of January -44, 1994 <br />Page <br />Miron made motion, Stoltzman seconded, directing the City Attorney to <br />research the ownership of the Brisson cemetery. <br />All aye. Motion Carried. <br />BALD EAGLE LAKE ACCESS REQUEST <br />Mr. Jack. Jungbauer, 12122 Everton Avenue North, addressed the Council <br />regarding possible implementation of controls on the use of the 121st <br />Street access to Fuld Eagle Lake. Mr. Jungbauer, and other neighbors, is <br />concerned about the noise associated with the late-night usage, and safety <br />of vehicular traffic where it enters onto Everton Avenue. <br />Miron made motion, Leroux; seconded, directing City staff to contact the <br />DNF requesting their opinion on the problems relating to this access. <br />All aye. Motion Carried. <br />FINAL FLAT REQUEST (SUNSET LAKE RIDGE <br />Mr. Thomas Frampton has requested final plat approval for SUNSET LAKE <br />RIDGE. The Council reviewed the proposed final plat, as well as <br />additional information on drainage flow. A chanqe that should be noted <br />from the approved preliminary plat is the exception on the east side of <br />Lot 9. It is the intention of Mr. Frampton to turn over ownership of this <br />exception to the adjacent property owner on the east in order to provide <br />the owner a row of established trees. Staff recommended approval of the <br />final plat, subject to signing of the Development Agreement between Mr. <br />and Mrs. Frampton and the City. Council member Barnes stated her concerns <br />with regard to inadequate septic systems adjacent to the lake, and their <br />negative impact on water quality. She felt that, in time, a small, <br />localized treatment center would be needed, and because this subdivision <br />drains into Sunset Lake, questioned whether language to that affect could <br />be added to the proposed Development Agreement. Attorney Galler stated <br />that Chapter 429 requirements would have to be followed making such <br />language unnecessary. <br />Miron made motion, Leroux; seconded, to approve the Development Agreement <br />between the City of Hugo and Mr. and Mrs. Thomas Frampton. <br />VOTING AYE: Brunotte, Leroux:, Miron, Stoltzman <br />VOTING NAY: Barnes <br />Motion Carried. <br />Leroux: made motion, Miron seconded, to approve the request of Thomas and <br />Colleen Frampton for final plat approval, SUNSET LAKE RIDGE. <br />VOTING AYE: Brunotte, Leroux:, Miron, Stoltzman <br />VOTING NAY: Barnes <br />Motion Carried. <br />
