'The area is currently zoned RR2. The south eastern five acre parcel would be landlocked, and the Pareigats have indicated their intention to sell this parcel to an adjacent property owner for inclusion in his property description. The Hugo FC considered this request at their meeting of May 25, 1994, and recommended approval of the subdivision subject to conditions. LerolAX made motion, Miron seconded, to approve the subdivision request of Gerhardt Pareigat for the subdivision of 20 acres into one 10 acre parcel and two five acre parcels, subject to the following conditions: 1. Parcel C be deeded to the adjacent property owner and included in their parcel description in order to avoid creation of a landlocked parcel. 2. Approval of the subdivision be subject to comments, restrictions, and requirements of the RCWD, if any. 3. Parkland dedication fee be collected, in the amount of $500.00, for Parcel B. All aye. SPECIALUSE PERMIT _(RIVER CITY _ASPHALT1 The Hugo Planning Commission conducted a public hearing on May 25, 1994, regarding an application for a SUP by Richard Carron and Darrel Hanson to conduct mining operations on the NW 1/4 of the SW 1/4 of Section 23, T31N, R21W, and the E 1/2 of the SE 1/4 of Section 23, T31N, R21W. The PG recommended approval of the SUP subject to the terms and conditions of the Settlement Agreement between the City of Hugo, River City Asphalt, and Hugo 2000, as recorded with the 10th Judicial Court, File No. C7-92-4225. Stoltzman made motion, Miron seconded, to approve the Special Use Permit for Richard Carron and Darrel Hanson to conduct mining operations on the NW 1/4 of the SW 1/4 of Section 23, T21N, R21W, and the E 1/2 of the SE 1/4 of Section 23, T31N, R21W, subject to the terms and conditions of the Settlement Agreement between the City of Hugo, River city Asphalt, and Hugo, 2000, as recorded with the 10th Judicial Court, File #C7-92-4225. All aye. Motion Carried. RICE LAME MEADOWS PHASE 2 (PUBLIC IMPROVEMENTS ACCEPTANCE) Howard A. KUU5i5to Consulting Engineers, Inc., recommended that the City accept the sanitary sewer and water main improvements in the Rice Lake Meadows Phase 2 for operation and maintenance, and stated that the one year warranty period for the improvements may begin on November 18, 1993, the day of the final inspection of the project. Jim Merila, Merila and Associates, had stated previously to the Administrator that there was some confusion regarding acceptance of these improvements, and has requested that the one year warranty period begin on the date of the City Engineer's inspection of the project.
