Motion Carried. <br />DRAFT STORMWATER MANAGEMENT PLAN <br />Previously, the Council received a copy of a draft Stormwater Management <br />Plan, as prepared by Pete Willenbring of OSM The Cit:! Administrator has <br />performed a review of the document.. and his comments were provided to the <br />Council for their review. <br />Miron made motion. Leroux seconded, directing (.,it,,, staff to place this <br />item on the agenda for the first meeting in January, 1995, <br />All aye. Motion Carried. <br />LETTER OF CREDIT REDUCTION (COUNTRY PONDS) <br />Mr. Tony Emmerich requested that the letter of credit provided to the City <br />as security for the construction of certain public improvements in the <br />Country Ponds development be reduced to reflect work performed to date. <br />The City Engineer recommended that the security be reduced to $40,00u0,00, <br />Miran made motion, Leroux seconded, that the Letter of Credit, security <br />for construction of certain public improvements in the COUNTRY PONDS <br />subdivision, be reduced to4t►,i►�ii►,i►ii, <br />All aye. Motion Carried. <br />WINTER ACCESS TO BALD EAGLE LAKE <br />Per Council request, staff reviewed the opticin of moving the winter access <br />to Fuld Eaq_le Labe from its location at 12�.1st Street to the north end of <br />the lake. A feasibility report, prepared by the City Engineer, was <br />submitted to the Council for their consideration. The City Administrator <br />discussed the acquisition of an easement for access across the property of <br />Bobber's Boats and Bait with the owner, Mr. Robert McElmury. Mr. McElmury <br />indicated that he would grant the access in return for removal of the <br />sunset Clause in his SUP for the site. 'The sunset clause provides the <br />City with an opportunity to purchase the property, at fair market value, <br />in approximately 30 years. As the City has the legal right to condemn and <br />acquire the property at any time, the marginal value of the sunset clause <br />is relatively small. The immediate benefit of a safe access to the lake <br />may be a good trade off for a purchase option available to the City three <br />decades from now. Residents adjacent to Bobber's Boats and Bait were <br />present, and submitted a petition stating their objection to placement of <br />the access at the north end of the lake. <br />Barnes made motion, Stolt man seconded, that the City close to vehicular <br />traffic, the 121st Street Bald Eagle Lake access during the 1994/95 winter <br />season. City staff to report to the Council how closure will be attained. <br />All aye. Motion Carried. <br />
