Hugo Planning Commission <br />November 14, 1979 <br />Page 2 of 3 <br />NEIL MCLEAN - DIVISION OF LAND ON 170TH STREET <br />Mr. McLean, realtor for Hermes, is selling land on 170th Street (Section 12). They <br />want to divide a 40 acre parcel into two 2.0 acre parcels with an easement to the back <br />20 acres to provide access. After review of the ordinance regarding Land Division, <br />the Commission had a problem as to whether the 33' easement would be public or private <br />and the rear lot would not have the required road frontage as stated in the ordinance. <br />McAllister requested the City Clerk obtain an opinion from the City Attorney regarding <br />this matter. The attorney is to refer to Land Division, Chapter 290-9, Subd. G. H, <br />and I. Mr. McLean requested that he be placed on the City Council's agenda for dis- <br />cussion of this matter. <br />TIM WALLACE - SPECIAL USE PERMIT <br />Mr, Wallace rents 42 acres at 4504 170th Street, all in the Agriculture zone. Mr. <br />Wallace owns 14 sled dogs, and has made application for a Special Use Permit for a <br />kennel. The dogs are used for sled races, and each has their own house. There <br />would be no new construction. It was determined that no application would be re- <br />quired (permitted use). <br />Motion made by McAllister, seconded by Lorch, that the Planning Commission recommends <br />the the City Council that they refund the applicant's fee of ;035.00 for the Special <br />Use Permit, as none is required according to Chapter 320-4, C2. <br />All aye.
