This would eliminate balls flying into the property located <br />east of Fitzgerald Avenue, except for tournament play where both fields <br />would be necessary. This option has the benefit of relieving the. City of <br />the cost of installing a fence, and would provide greater relief to the <br />property owner in question. <br />Miron made motion, Barnes seconded, to accept staff's recommendation so <br />that adult softball games be scheduled on the northwestern field so that <br />players would be batting towards the cemetery, <br />VOTING AYE: Barnes, Miron, Stoltzman <br />VOTING NAY: Brunotte <br />ABSTAINED: Leroux <br />Motion Carried. <br />OPEN MEETING L.AW F I ND I NGS <br />The Council received the revised Findings by City Attorney, Greg Galler, <br />regarding the recent court case involving Sell Publishing and the City <br />Council. Mr. Galler is recommending acceptance of the Findings by the <br />Council, and approval of a Petition to the 10th Judicial District for <br />review of the Findings and approval of the City's reimbursement to the <br />Council of legal expenses incurred in this matter. <br />Leroux made motion, Brunotte seconded, directing the City Attorney, Greg <br />Galler, to file the Findings of Fact along with the Petition for review <br />and other documents with the District Court. <br />All aye.
